Pursuant to Article 61 of Decree 116/2021/ND-CP stipulates the above issue as follows:

1. During the execution of the decision, if the drug addict dies, the Director of the rehabilitation facility is required to notify in writing the investigation agency, People's Procuracy, and district-level People's Court. where the rehabilitation facility is located, the nearest medical agency and the drug addict's relatives to make a record confirming the cause of death. The making of a record must be witnessed by a drug addict.

In case the drug addict dies without relatives or after 24 hours from the notification but the drug addict's relatives are not present, a record will be made with the witness of 02 drug addicts.

2. Compulsory rehabilitation facilities are responsible for immediately notifying relatives of the deceased drug addict for burial. In case there are no relatives or the relatives do not arrive within 24 hours, the director of the compulsory rehabilitation facility is responsible for organizing the funeral. Funeral costs are guaranteed by the State; The minimum level of funeral cost support is equal to 20 times the standard social assistance level according to Decree No. 20/2021/ND-CP dated March 15, 2021 stipulating social assistance policies for social protection subjects.

What are regulations on expiration of time limit for being sent to a compulsory rehabilitation facility in Vietnam?

Pursuant to Article 62 of Decree 116/2021/ND-CP, it is stipulated as follows:

1. No later than fifteen days before the expiration of the time limit for being sent to a compulsory rehabilitation facility, the Director of the compulsory rehabilitation facility is responsible for notifying the district People's Court where the decision has been issued and the the commune-level People's Committee where the dossier is prepared, family representatives (father, mother, spouse, siblings), legal representatives of people from 12 years old to under 18 years old know the date the person will finish duration of compulsory rehabilitation measures.

2. The director of the compulsory rehabilitation facility shall issue a certificate of completion of the decision to send to the compulsory rehabilitation facility according to Form No. 46, Appendix II of this Decree and send a copy to the district-level People's Court where has issued a decision, the Department of Labor, War Invalids and Social Affairs, the People's Committee of the commune where the person after rehabilitation resides, family representatives (father, mother, spouse, siblings), legal representation of people from 12 years old to under 18 years old.

3. For people from 12 years old to under 18 years old who have completed the decision but have no family to pick them up, the Director of the compulsory rehabilitation facility is responsible for taking them back to their family or the People's Committee of commune level where the drug addict resides according to Form No. 47, Appendix II of this Decree.

4. People who have completely complied with the decision will receive their money and deposited items back, diplomas and certificates of educational and vocational training (if any); They will be given transportation fares, food expenses, and a set of regular clothes (if they do not have any) and must return mats, blankets, mosquito nets, and other items and equipment used for studying, working, and daily living. compulsory drug rehabilitation facilities on loan; If lost, compensation must be made.

5. Within 05 working days from the date of returning to the locality, the person who has completed complying with the decision must report to the Commune-level People's Committee and the Police agency at the same level where he or she resides.
