What is November 14 in Vietnam? 

Pursuant to Article 1 of Decision 890/QD-TTg in 2015:

Article 1. November 14 each year is designated as “Vietnam Agricultural and Rural Development Tradition Day.”

Thus, November 14 is the Vietnam Agricultural and Rural Development Tradition Day.

The organization of Vietnam Agricultural and Rural Development Tradition Day must meet the following contents and requirements:

- Practical, economical, effective, and avoiding formality.

- Educating tradition, motivating labor, work emulation movements, raising awareness of organizational discipline, responsibility in performing duties, public service, and the revolutionary ethics of officials and public employees in the Agriculture and Rural Development sector.

- Commending and rewarding in forms suitable with the legal provisions to groups and individuals with achievements in building the Agriculture and Rural Development sector, exemplary in implementing the Party’s guidelines, policies, and State laws.

Based on Article 112 of the Labor Code 2019:

Article 112. Holidays

  1. Employees are entitled to fully paid leave on the following holidays and Tet:

a) New Year: 01 day (January 1 of the Gregorian calendar);

b) Lunar New Year: 05 days;

c) Victory Day: 01 day (April 30 of the Gregorian calendar);

d) International Labor Day: 01 day (May 1 of the Gregorian calendar);

dd) National Day: 02 days (September 2 of the Gregorian calendar and 01 adjacent day before or after);

e) Hung Kings Commemoration Day: 01 day (March 10 of the lunar calendar).

  1. Employees who are foreigners working in Vietnam, in addition to the holidays prescribed in Clause 1 of this Article, are entitled to one more traditional New Year holiday of their nationality and one National Day of their country.
  1. Annually, based on actual conditions, the Prime Minister of the Government of Vietnam decides specifically the holidays stipulated at Point b and Point dd, Clause 1 of this Article.

According to the above regulations, employees are entitled to fully paid days off on the following days:

- New Year: 01 day (January 1 of the Gregorian calendar)

- Lunar New Year: 05 days

- Victory Day: 01 day (April 30 of the Gregorian calendar)

- International Labor Day: 01 day (May 1 of the Gregorian calendar)

- National Day: 02 days (September 2 of the Gregorian calendar and 01 adjacent day before or after)

- Hung Kings Commemoration Day: 01 day (March 10 of the lunar calendar)

Additionally, foreigners working in Vietnam are entitled to one more traditional New Year holiday of their nationality and one National Day of their country.

Thus, on November 14, 2024, employees are not entitled to paid leave.

However, employees can still use their annual leave days (Article 113 of the Labor Code 2019) or take unpaid leave after agreeing with the employer (Article 115 of the Labor Code 2019).

What are rights and obligations of employees in Vietnam?

According to Article 5 of the Labor Code 2019, the rights and obligations of employees are stipulated as follows:

[1] Employees have the following rights:

- Work; freely choose employment, workplace, occupation, training, and improve occupational skills; not be discriminated against, forced labor, sexual harassment at the workplace

- Receive wages that correspond to their qualifications, skills based on agreement with the employer; be protected in labor, work in conditions ensuring safety, and occupational hygiene; take leave according to policies, receive annual paid leave, and collective welfare benefits

- Establish, join, operate in representative organizations for employees, occupational organizations, and other organizations as per legal regulations; require, participate in dialogue, implement democratic regulations, conduct collective bargaining with the employer and be consulted at the workplace to protect their lawful and legitimate rights and interests; participate in management following the employer's rules

- Refuse to work if a clear danger threatens life, health during work

- Unilaterally terminate the labor contract

- Strike

- Other rights as prescribed by law

[2] Employees have the following obligations:

- Implement labor contracts, collective labor agreements, and other lawful agreements

- Abide by labor discipline, work rules; follow the management, direction, supervision of the employer

- Comply with labor laws, employment, vocational training, social insurance, health insurance, unemployment insurance, and safety regulations, occupational hygiene
