March 8 is International Women's Day. This day is to honor the contributions of women in all aspects of life, from family, society to economy, politics, and culture.
This day originated from the movement for women's rights by female employees in America and Europe in the late 19th and early 20th centuries. By 1910, at the International Women's Conference in Denmark, March 8 was officially chosen to be International Women's Day.
Today, many countries around the world, including Vietnam, organize activities to honor and appreciate women on this day. It is also an occasion to raise awareness about gender equality and women's rights.
Thus, every March 8 is International Women's Day. According to the Luna Calendar, March 8, 2025, corresponds to the lunar date of February 9, 2025.

What is the maternity leave duration for female employees in Vietnam?
Pursuant to Article 139 of the Labor Code 2019, regulations on maternity leave are as follows:
Article 139. Maternity Leave
- Female employees are entitled to 06 months of maternity leave before and after childbirth; the pre-birth leave period should not exceed 02 months.
In the case of giving birth to twins or more, from the second child onwards, the mother is entitled to one additional month per child.
- During the maternity leave, female employees are entitled to maternity benefits following regulations of the law on social insurance.
- After the prescribed maternity leave duration in Clause 1 of this Article, if desired, female employees may take an additional unpaid leave period after negotiating with the employer.
- Prior to the end of the maternity leave period as stipulated in Clause 1 of this Article, female employees may resume work after taking leave for a minimum of 04 months, provided that the employee must notify, obtain the employer's consent, and have confirmation from a competent medical facility that early resumption does not harm the employee's health. In this case, besides the wages paid by the employer for working days, the female employee continues to receive maternity allowances as stipulated by the law on social insurance.

According to the above regulations, the maternity leave duration for female employees before and after childbirth is 06 months; the pre-birth leave period does not exceed 02 months. If the female employee gives birth to twins or more, from the second child onwards, she is entitled to an additional month of leave for each child.
Which female employees are entitled to maternity benefits when participating in compulsory social insurance in Vietnam?
According to Article 50 of the Social Insurance Law 2024, the regulation on subjects and conditions entitled to maternity benefits is as follows:
Article 50. Subjects and conditions entitled to maternity benefits
- Individuals specified in points a, b, c, d, i, k, l, m and n of Clause 1 and Clause 2 of Article 2 of this Law are entitled to maternity benefits in one of the following cases:
a) Female employees who are pregnant;
b) Female employees who give birth;
c) Female employees who are surrogate mothers;
d) Female employees who utilize surrogacy;
đ) employees who adopt a child under 06 months old;
e) employees using contraceptive methods that require procedures at medical facilities;
g) Male employees participating in compulsory social insurance with wives giving birth, or having a wife surrogate.
- The individuals specified in points b, c, d, and đ of Clause 1 of this Article must have contributed to compulsory social insurance for at least 06 months in the 12 months preceding childbirth or adoption when utilizing surrogacy or adopting a child under 06 months old.

Based on the above provisions, female employees who are entitled to maternity benefits when participating in compulsory social insurance are as follows:
[1] Must be one of the following subjects:
- Individuals working under indefinite-term labor contracts, fixed-term labor contracts with a duration of 01 month or more, including cases where the employee and employer agree with different names but the content reflects paid work, wages, and the management, supervision, and direction of one party
- Officials and public employees
- Defense force employees and public security employees and those working in cryptographic organizations
- Officers, professional soldiers in the People's Army; officers, technical non-commissioned officers, professional technical officers in the People's Public Security; individuals working in cryptographic positions paid like military personnel
- Enterprise managers, supervisors, representatives of the state's capital share, representatives of the enterprise's capital share according to the law; members of the Board of Directors, General Directors, Directors, members of the Supervisory Board, or supervisors and other management positions elected by cooperatives, joint cooperatives according to regulations
- Non-specialized personnel at communal, village, and neighborhood levels
- Subjects specified at point a of this section working part-time, with a monthly salary equal to or higher than the salary used as a basis for calculating the lowest compulsory social insurance contribution
- Business household heads of registered business households participating according to the regulations of the Government of Vietnam
- Enterprise managers, supervisors, representatives of the state's capital share, representatives of the enterprise's capital share according to the law; members of the Board of Directors, General Directors, Directors, members of the Supervisory Board, or supervisors and other management positions elected by cooperatives, joint cooperatives in accordance with the Cooperative Law without receiving wages
- Foreign nationals working in Vietnam included in the compulsory social insurance scheme when working under definite-term labor contracts of 12 months or more with employers in Vietnam, except in the following cases:
+ Intra-corporate transferees in accordance with the law on foreign employees working in Vietnam
+ At the time of entering into the labor contract, they have reached retirement age
+ International agreements to which the Socialist Republic of Vietnam is a signatory, providing different regulations
[2] Must fall into one of the following conditions:
- Female employees who are pregnant
- Female employees who give birth
- Female employees who are surrogate mothers
- Female employees who utilize surrogacy
- employees who adopt a child under 06 months old
- employees who use contraceptive methods requiring procedures in medical facilities
- Male employees participating in compulsory social insurance with wives giving birth, or having a wife surrogate.
