What are regulations on salaries of employees working during the Lunar New Year in 2025 in Vietnam?
Pursuant to Article 98 of the Labor Code 2019 regarding overtime pay, and night work pay:
Article 98. Overtime pay, and night work pay
- Employees working overtime are paid wages based on the wage unit price or actual wage for the job being done as follows:
a) On regular days, at least 150%;
b) On weekly rest days, at least 200%;
c) On public holidays, paid leave days, at least 300% not including the wage for public holidays, paid leave days for employees receiving hourly wages.
- Employees working at night are paid at least an additional 30% of the wage calculated based on the wage unit price or the actual wage paid for the job of a normal working day.
- Employees working overtime at night are entitled to an additional 20% wage calculated on the wage unit price or wage for the daytime work of a normal working day or a weekly day off or a public holiday in addition to wages stipulated in clauses 1 and 2 of this Article.
- The Government of Vietnam provides detailed regulations for this Article.
Thus, employees working overtime on the Lunar New Year 2025 are paid wages at least 300% not including the wage for public holidays or paid leave days for hourly wage employees.
Employees working at night are paid at least an additional 30% of the wage calculated on the wage unit price or the actual wage paid for a normal working day.
In addition, employees working overtime at night are entitled to an additional 20% of the wage calculated on the wage unit price or the wage for the daytime work of a normal working day or a weekly day off or a public holiday as stipulated.
Are individuals in Vietnam allowed to set off fireworks during the Lunar New Year 2025?
Pursuant to Clause 1, Article 17 of Decree 137/2020/ND-CP on the use of fireworks:
Article 17. Use of fireworks
- Agencies, organizations, and individuals with full civil capacity are allowed to use fireworks in the following circumstances: festivals, Tet holidays, birthdays, weddings, conferences, inaugurations, anniversaries, and in cultural and artistic activities.
- Agencies, organizations, and individuals may only purchase fireworks from organizations and enterprises authorized to produce and trade in fireworks.
Pursuant to Clauses 3 and 7, Article 11 of Decree 144/2021/ND-CP on violations involving the management and use of weapons, explosives, explosive precursors, support tools, fireworks, and banned toys:
Article 11. Violations involving management and use of weapons, explosives, explosive precursors, support tools, fireworks, and banned toys

- A fine ranging from 5,000,000 VND to 10,000,000 VND shall be imposed on any of the following acts:

i) Illegal use of various types of fireworks, firework powder;

- Additional penalties:
a) Confiscation of exhibits and means of administrative violations for acts specified at Points d and đ Clause 1; Points a, b, c, e, and g Clause 2; Points a, c, d, đ, e, h, i, and k Clause 3; Points a, b, c, d, đ, e, h, and i Clause 4 and Clause 5 of this Article;
b) Revocation of the license to use or the certificate of registration for weapons and support tools from 03 to 06 months for acts specified at Point e Clause 2 of this Article;
c) Revocation of the license, certificate of registration, certificate, or certificate of fireworks from 09 to 12 months for acts specified at Point a Clause 2 and Points b and k Clause 3 of this Article.

Individuals with full civil capacity are allowed to use fireworks during the Lunar New Year 2025.
However, individuals must purchase fireworks from organizations and enterprises of the Ministry of National Defense permitted to produce, trade in fireworks, or licensed organizations permitted to trade in fireworks.
In the case of illegal use of fireworks by individuals, a fine ranging from 5,000,000 VND to 10,000,000 VND shall be imposed and the confiscation of exhibits and means of administrative violations will occur.
