What is cost of managing policies and preferential regimes for people with meritorious services to the revolution in Vietnam?

In Clause 1, Article 7 of Circular 44/2022/TT-BTC (effective from September 5, 2022) stipulates cost of managing policies and preferential regimes for people with meritorious services to the revolution as follows:

1. The central budget covers administrative expenses for performing professional activities on management of subjects, records, financial management, accounting and payment organization.

The level of administrative expenses is equal to 1.7% of the total funding for implementation of preferential policies for people with meritorious services to the revolution (except for funding to support establishments for nurturing and nursing people with meritorious services to the revolution and working expenses, martyrs' graves and martyrs' cemeteries) and shall be included in the annual budget estimates for the implementation of the annual policy of preferential treatment for people with meritorious services to the revolution of the Ministry of Labor, War Invalids and Social Affairs; in which the cost of service payment to the beneficiary is up to 0.75% of the total expenditure of the whole industry; The Ministry of Labor, War Invalids and Social Affairs shall decide to allocate the ratio of administrative expenses and the proportion of expenses for payment of regimes in accordance with the particularities of each locality, ensuring within the scope of the assigned estimates for each locality management of the entire industry.

What are contents and cost of managing policies and preferential regimes for people with meritorious services to the revolution in Vietnam? 

According to Clause 2, Clause 3, Clause 4, Article 7 of Circular 44/2022/TT-BTC (effective from September 5, 2022) stipulating contents and cost of managing policies and preferential regimes for people with meritorious services to the revolution, as follows:

2. Content and level of management expenses;

a) Expenses for disseminating preferential policies for people with meritorious services to the revolution: The content and level of expenditure are specified in the Joint Circular No. 14/2014/TTLT-BTC-BTP dated January 27, 2014 of the Ministry of Finance. The Ministry of Justice shall stipulate the estimation, management, use and finalization of state budget funds to ensure the dissemination and education of laws and the standards of people's access to law at the grassroots level;

b) Spending on information and propaganda on policies, management and care of people with meritorious services to the revolution: Heads of agencies and units assigned to carry out the task of information and propaganda are responsible for selecting the image, ensuring the principle of thrift and efficiency, within the scope of the estimate assigned by the competent authority;

c) Expenses for supporting information technology application in service of financial management, management of dossiers and subjects, payment of incentives, and martyrs' graves: Comply with the provisions of Decree No. 73/2019/ND-CP dated September 5, 2019 of the Government regulating investment management of information technology application using state budget capital, Decree No. 64/2007/ND-CP dated May 10 4 2007 of the Government on the application of information technology in the operation of state agencies and guiding documents;

d) Expenses for stationery, printing, photocopying of documents, forms, notices, reports, purchase of books and documents in service of management: Actual payment level within the estimated budget approved by competent authorities;

dd) Expenses for transferring money to policy beneficiaries, payment service agencies, and expenses for making ATM cards for beneficiaries who request payment via banks; cash shipping costs; Cost of renting payment sites, security forces, drinking water for beneficiaries at payment points: Fees according to invoices, documents, contracts (in case of service hire) and within the estimate assigned;

c) Payment of remuneration to the person who directly pays benefits to the beneficiary (in the case of the Labor - Invalids and Social Affairs agency or the agency assigned to make payment): the remuneration to the person directly paying the allowance shall be decided by the Director of the Department of Labor - Invalids and Social Affairs in accordance with the actual conditions in the locality and the guidance of the Ministry of Labor - Invalids and Social Affairs;

g) Expenses for hiring a service organization to pay benefits to beneficiaries:

- The level of expenses paid to the service organization shall be determined as a percentage (%) of the total amount of allowances and allowances paid to beneficiaries by the Minister of Labor and War Invalids and Society decides according to local conditions and the actual number of subjects in each locality;

- The payment service organization makes its own decision and is responsible for the costs for: Procurement of safes, money counting machines, money packaging, ordinal number generators (if any); rent means of money transport, payment locations, security forces; money transfer costs, overnight deposit fees, cash withdrawal fees, money transfer service fees to the beneficiary's account; the cost of making an ATM card for the beneficiary who requires payment via a bank; remuneration for payment; drinking water at payment points; expenses for preservation and storage of the pay list; repair facilities, machinery and equipment at payment points; system management fee; fees for renting technical infrastructure for payment and other expenses;

- The payment service organization is responsible for paying the full amount of allowances and allowances to beneficiaries within the prescribed time limit. For the funds already assigned to the service organization to pay the beneficiaries, in case of loss of the beneficiary's allowance, the paying service organization is responsible for refunding 100% of the amount of money;

h) Expenses for approval, appraisal and adjustment of dossiers of meritorious persons: Maximum support level is 60,000 VND/document. Based on the actual situation in the locality and the assigned estimate, the Director of the Department of Labor, War Invalids and Social Affairs shall decide specifically the level of support and allocation of funds to the agencies and units participating in the approval, appraisal and adjustment of dossiers;

i) Expenses for professional training and retraining, preliminary and final reviews, seminars and workshops to exchange professional knowledge and experiences on organizing the implementation of preferential policies for people with meritorious services to the revolution: Contents and expenditures shall be implemented according to regulations. 36/2018/TT-BTC dated March 30, 2018 of the Ministry of Finance guiding the estimation, management, use and settlement of funds for training and retraining of staff. Ministries, civil servants and public employees and Circular No. 40/2017/TT-BTC dated April 28, 2017 of the Ministry of Finance stipulating the regime of working-trip allowances and conference expenses (hereinafter referred to as Circular No. 40/2017/TT-BTC);

k) Expenses to support inspection and examination; making estimates, reviewing, approving and appraising the final settlement of funds for the implementation of the policy of preferential treatment for people with meritorious services; Expenditure on business trip expenses for appraisal, verification and handling of dossiers of meritorious persons: The contents and levels of expenses shall comply with the regime of working-trip allowances specified in Circular No. 40/2017/TT- BTC;

l) Spending on night work and overtime according to the provisions of the Labor Code , Decree No. 145/2020/ND-CP dated December 14, 2020 of the Prime Minister detailing and guiding the implementation of a number of articles. of the Labor Code on labor conditions and labor relations and Joint Circular No. 08/2005/TTLT-BNV-BTC dated January 5, 2005 of the Ministry of Home Affairs and the Ministry of Finance guiding the implementation of the regime pay wages for working at night and overtime for public servants and public employees;

m) Expenses for petrol and oil and communications in service of the implementation of preferential policies for people with meritorious services: Expenses shall be made according to invoices, vouchers and contracts (in case of job assignment and service hire);

n) Expenses for procurement and repair of assets, equipment and means for payment and management of objects and management of funds: Comply with approval decisions of competent authorities and according to regulations of the law on bidding;

o) Expenses for assessment of criminal technical documents and dossiers of meritorious persons: Fees according to invoices of assessment establishments;

p) Expenses for hiring, work assignment contracts and other expenses in service of management: Expenses made according to contracts, receipts or invoices (in case of job assignment and service hire);

q) Expenses for welcoming people with meritorious services to the revolution: The level of expenditure is based on the level of expenditure for receiving domestic guests specified in the Circular No. 71/2018/TT-BTC dated August 10, 2018 of the Ministry of Finance regulating the regime of receiving guests. Foreigners come to work in Vietnam, the regime of spending on organizing international conferences and seminars in Vietnam and the regime of receiving domestic guests.

3. Expenses for management work at the Central Government according to the expenditures specified in Clause 2 of this Article shall be allocated, used and settled in the annual recurrent expenditures of the Ministry of Labor, War Invalids and Social Affairs.

4. For expenses for management of implementation of policies and one-time subsidies for people directly participating in the resistance war according to Decisions No. 290/2005/QD-TTg, No.142/2008/QD-TTg , No. 53/2010/QD-TTg, No. 62/2011/QD-TTg and No.57/2013/QD-TTg:

Follow the instructions in the Joint Circulars: No. 21/2008/TTLT-BQP-BLDTBXH-BTC dated February 26, 2008 of the Ministry of National Defense, the Ministry of Labor - Invalids and Social Affairs, and the Ministry of Finance, as amended. , supplementing Circular No. 191/2005/TTLT-BQP-BLDTBXH-BTC; No. 144/2008/TTLT-BQP-BDTTBXH-BTC dated November 27, 2008 of the Ministry of National Defense, the Ministry of Labor, War Invalids and Social Affairs, and the Ministry of Finance guiding the implementation of Decision No. 142 /2008/QD-TTg; No. 05/2010/TTLT-BCA-BLDTBXH-BTC dated November 8, 2010 of the Ministry of Public Security, the Ministry of Labor, War Invalids and Social Affairs, and the Ministry of Finance guiding the implementation of Decision No. 53 /2010/QD-TTg; No. 01/2012/TTLT-BQP-BLDTBXH-BTC dated January 5, 2012 of the Ministry of National Defense, the Ministry of Labor - Invalids and Social Affairs and the Ministry of Finance guiding the implementation of Decision No. 62 /2011/QD-TTg ; No. 08/2012/TTLT-BLDTBXH-BNV-BTC dated April 16, 2012 of the Ministry of Labor, War Invalids and Social Affairs, the Ministry of Home Affairs, and the Ministry of Finance guiding the implementation of the allowance regime for young volunteers who completed the task in the resistance war according to Decision No. 40/2011/QD-TTg.
