How many days off are employees in Vietnam entitled to for the New Year 2025?

Pursuant to Article 112 of the Labor Code 2019 stipulating holiday:

Article 112. Holidays

  1. Employees are entitled to take leave with full pay on the following holidays:

a) New Year's Day: 1 day (01 January);

b) Lunar New Year: 5 days;

c) Victory Day: 1 day (April 30);

d) International Labor Day: 1 day (May 1);

dd) National Day: 2 days (September 2 and 1 day either before or after);

e) Hung Kings' Commemoration Day: 1 day (March 10 of the lunar calendar).

  1. Foreign employees working in Vietnam, in addition to holidays stipulated in Clause 1 of this Article, are entitled to an additional day off for their traditional New Year's Day and National Day.
  1. Annually, based on actual conditions, the Prime Minister of the Government of Vietnam decides specific days off stipulated at Point b and Point dd of Clause 1 of this Article.

What is the salary for employees in Vietnam working on New Year's Day 2025?

Pursuant to Article 98 of the Labor Code 2019 stipulating overtime and night work pay:

Article 98. Overtime and Night Work Pay

  1. Employees working overtime are paid according to the wage unit price or the actual wage for the work they are doing as follows:

a) On weekdays, at least 150%;

b) On weekly days off, at least 200%;

c) On holidays and Tet days, at least 300% not including the salary for holidays, Tet days, and paid days off for employees with daily wages.

  1. Employees working at night are paid an additional 30% of the wage computed on the wage unit price or the actual wage for the normal working day.
  1. Employees working overtime at night, in addition to being paid as prescribed in Clauses 1 and 2 of this Article, are paid an additional 20% based on the wage unit price or the wage for the daytime work of a regular working day, weekly day off, or holiday, Tet day.
  1. The Government of Vietnam provides details on this Article.

Thus, according to the above regulations, when working on New Year's Day 2025, the employee's salary is calculated as follows:

- 100%: Normal working day

- 300%: Holiday, Tet day

- 30%: Night work

- 60%: 20% X actual wage for daytime work on holiday or Tet day (300%).

Therefore, the total salary that an employee receives when working overtime at night on a holiday or Tet day is:

- Working during the day: Receives at least 400% of salary/day.

- Working at night: Receives at least 490% of salary/day.
