Are pregnant women eligible for priority seats on buses in Vietnam?

Pursuant to Clause 2 Article 5 of the Decree 10/2020/ND-CP stipulating fixed-route bus business as follows:

Fixed-route bus business

1. Enterprises and cooperatives granted the auto transport business license which permits fixed-route bus business may participate in bidding or receive orders regarding operation of bus routes included in published route network lists.

2. Automobiles used for bus business shall:

a) Reserve priority seats for people with physical disabilities, the elderly and pregnant women;

b) Have the “XE BUÝT” (“BUS”) signage affixed beneath the front windscreen on the right-hand side and have all required information affixed on their bodies;

c) Have at least 17 seats. Location and number of seats and standing passengers and other technical regulations for buses shall comply with the technical regulations promulgated by the Ministry of Transport. Automobiles having between 12-17 seats may be used for bus routes running through bridges whose load capacity is less than 05 tonnes or bus routes 50% of which consists of roads below level IV (or roads whose cross section is less than 07 meters).

As regulations above, automobiles used for bus business shall reserve priority seats for people with physical disabilities, the elderly and pregnant women.

Pregnant women are eligible for priority seats on buses in Vietnam.

What are the fines imposed on buses for failure to reserve priority seats for pregnant women in Vietnam?

Pursuant to Clause 2 Article 28 of the Decree 100/2019/ND-CP (amended by Clause 15 Article 2 of the Decree 123/2021/ND-CP) stipulating penalties for violations against regulations on road transport and ancillary services for road transport as follows:

2. A fine ranging from VND 1,000,000 to VND 2,000,000 shall be imposed upon an individual, from VND 2,000,000 to VND 4,000,000 upon an organization that commits any of the following violations:

d) Failure to put or failure to accurately and adequately put the name and phone number of the taxi truck service provider, the net weight of the vehicle, the maximum permissible payload of the vehicle on the outer sides of the body or doors of the taxi truck as prescribed;

dd) Failure to put up or accurately and adequately put up the license plates; luggage allowance, hotline number;

e) Failure to number seats and beds on a passenger-carrying motor vehicle as prescribed;

g) Operating a vehicle providing passenger transportation services along fixed routes or vehicle providing passenger transportation services in form of buses that are not installed with priority seats for persons with disabilities, old people and pregnant women as per the law;

h) Operating a passenger vehicle without providing passengers with instructions on traffic safety and emergency exit upon vehicular accidents as per the law.

i) Failure to provide ticket refund to passengers in the case of a fixed route covering a distance of less than 300 km.

3. A fine ranging from VND 2,000,000 to VND 3,000,000 shall be imposed on an individual and from VND 4,000,000 to VND 6,000,000 on an organization that commits any of the following offences:

a) Loading cargo on each vehicle (including trailer and semi-trailer) beyond the maximum permissible payload written on the certificate of technical and environmental safety inspection by more than 50% to 100%;

b) Failure to provide ticket refund to passengers in the case of a fixed route covering a distance of more than 300 km;

c) Failure to return badges to the provincial Department of Transport as prescribed.

As regulations above, individual business owners operating bus transportation without priority seating for pregnant women will be fined from 1,000,000 VND to 2,000,000 VND.

In the case of organizations operating bus transportation without priority seating for pregnant women, the fine will range from 2,000,000 VND to 4,000,000 VND.
