In Clause 1, Article 24 of the Ordinance on preferential treatment for people with meritorious services to the revolution, the preferential regime for war invalids is stipulated as follows:

1. Monthly allowances and benefits for war invalids and beneficiaries of the same compensation policies as war invalids are as follows:

a) Monthly allowance is based on the rate of physical injury and type of wounded soldier;

b) Servant allowances for war invalids and beneficiaries of the same compensation policies as war invalids with a physical injury rate of 81% or higher living at home;

c) Monthly allowances for war invalids and beneficiaries of the same compensation policies as war invalids with a physical injury rate of 81% or higher;

d) Special monthly allowances for war invalids and beneficiaries of the same compensation policies as war invalids with a physical injury rate of 81% or more and particularly severe injuries. War invalids and beneficiaries of the same compensation policies as war invalids and receive special monthly allowances do not receive monthly allowances.

According to Clause 1, Article 25 of the Ordinance on preferential treatment for people with meritorious services to the revolution, it stipulates preferential treatment for relatives of war invalids and beneficiaries of the same compensation policies as war invalids:

1. Health insurance for the following people:

a) Natural father, biological mother, spouse, children from 6 years old to under 18 years old or 18 years old or older if they are still in school or have severe disabilities or especially severe disabilities of war invalids, beneficiaries of the same compensation policies as war invalids have a physical injury rate of 61% or higher;

b) People serving wounded soldiers, beneficiaries of the same compensation policies as war invalids with a physical injury rate of 81% or more living at home.

Thus, if you are the person who serves your friend infected with chemical toxins, you are entitled to monthly benefits and allowances, and the State will buy health insurance and issue a free health insurance card in Vietnam.

What are principles for enjoying benefits for partisans infected with toxic chemicals in Vietnam? 

Pursuant to Article 58 of Decree 131/2021/ND-CP on principle of enjoying benefits for partisans infected with toxic chemicals, accordingly:

1. If a person is receiving invalid war benefits, if eligible, he/she will be entitled to additional benefits for partisans infected with toxic chemicals.

2. In case of concurrently receiving invalid and sick soldier benefits, if eligible, he/she will be entitled to benefits for partisans infected with toxic chemicals according to the provisions of Points b, c, and point d Clause 1, Article 30 of the Ordinance.

3. In case he/she is receiving a monthly benefit corresponding to a level with a bodily injury rate of 81% or higher but the dossier does not contain a medical examination record or the medical examination record does not comply with regulations, it will not apply service allowances and special allowances; Other preferential regimes are the same as those with a physical injury rate of 81% or higher.

According to this Article, comparing the above regulations in Vietnam, if an individual falls into one of the above cases, partisans infected with toxic chemicals are entitled to this regime.
