When can a marriage registration be denied in Vietnam?
According to Article 33 of Decree 123/2015/ND-CP on refusal to register marriage:
Article 33. Refusal to Register Marriage
- Marriage registration is refused if one or both parties violate prohibitions or do not meet the conditions for marriage as prescribed by the Law on Marriage and Family of Vietnam.
- In case the People's Committee of the district refuses to register the marriage, the Justice Department shall notify in writing, clearly stating the reasons to both parties.
According to the above provisions, registration is refused in the following cases:
- Violation of prohibitions
- Do not meet the conditions for marriage
Who has the right to request the annulment of an unlawful marriage in Vietnam?
According to Article 10 of the Law on Marriage and Family 2014 on the right to request the annulment of an unlawful marriage in Vietnam:
Article 10. Persons Entitled to Request the Annulment of an Illegal Marriage
- Persons who are coerced into marriage, deceived into marriage, have the right to self-request or suggest individuals or organizations specified in clause 2 of this Article to request the court to annul the illegal marriage as the marriage violates the provision at point b clause 1 Article 8 of this Law.
- The following individuals, agencies, organizations, according to the provisions of civil procedure law, have the right to request the court to annul the illegal marriage as the marriage violates the provisions at points a, c, and d clause 1 Article 8 of this Law:
a) The spouse of a person who is married, but marries another person; parents, children, guardians, or other legal representatives of the person illegally married;
b) State management agencies in charge of families;
c) State management agencies in charge of children;
d) The Women's Union.
- Other individuals, agencies, and organizations that discover an illegal marriage have the right to suggest the agencies, organizations specified at points b, c, and d clause 2 of this Article request the court to annul the illegal marriage.
According to the above provisions, the entities entitled to request the annulment of an illegal marriage include:
