Can individuals in Vietnam use fireworks during the Lunar New Year?
Pursuant to Article 17 of Decree 137/2020/ND-CP regulating the use of fireworks:
Article 17. Use of Fireworks
- Agencies, organizations, and individuals with full civil act capacity can use fireworks in the following cases: festivals, Tet, birthdays, weddings, conferences, openings, commemorations, and in cultural and artistic activities.
- Agencies, organizations, and individuals when using fireworks must only purchase them from organizations and businesses authorized to produce and trade in fireworks.
Thus, individuals with full civil act capacity are allowed to use fireworks for the Lunar New Year in 2025 and must only purchase them from authorized organizations and businesses.
Which authority in Vietnam has the jurisdiction to permit the firing of fireworks?
Based on Article 12 of Decree 137/2020/ND-CP (amended by clause 3 Article 3 of Decree 56/2023/ND-CP) regulating the authority, procedures for permitting firework displays:
Article 12. Authority and Procedures for Permitting Firework Displays
- The cases for organizing firework displays as stated in clauses 1, 2, 3, 4, 5, and 6 of Article 11 of this Decree are decided by the People's Committees of provinces and central-affiliated cities based on local actual conditions and are organized in cooperation with the Ministry of Culture, Sports and Tourism according to regulations.
- In cases of organizing firework displays as per clauses 7 and 8 of Article 11 of this Decree and other cases of changing the range and duration of firework displays, the Minister of Culture, Sports and Tourism shall decide after having a unanimous written agreement with the Ministry of Public Security and the Ministry of National Defense.
- Provinces and central-affiliated cities wishing to organize firework displays according to clauses 7 and 8 of Article 11 of this Decree or wanting to change the range and duration must send a written proposal to the Ministry of Culture, Sports and Tourism at least 30 days before the scheduled firework display, detailing the number, range, locations, time, duration, and places of the proposed display.
Within 05 working days from the date of receipt, the Ministry of Public Security and the Ministry of National Defense shall provide a written reply for the Ministry of Culture, Sports and Tourism to compile and decide.
According to the above regulations, the authority to permit firework displays is specified as follows:
- The People's Committees of provinces and central-affiliated cities decide based on local actual conditions and cooperate with the Ministry of Culture, Sports and Tourism to organize firework displays on the following occasions:
+ Lunar New Year
+ Hung Kings' Commemoration
+ National Day
+ Dien Bien Phu Victory Day
+ Victory Day (April 30)
+ Commemoration of the liberation day, the founding of centrally-run provinces and cities
- The Minister of Culture, Sports and Tourism decides after obtaining a written agreement from the Ministry of Public Security and the Ministry of National Defense to organize firework displays on the following occasions:
+ National or international cultural, tourism, and sports events.
+ Other cases as decided by the Prime Minister of the Government of Vietnam.
