As prescribed in Subsection 8, Section IV of the Implementation Plan for Decree No. 116/2021/ND-CP dated December 21, 2021 of the Government detailing some articles of the Law on Prevention and Control of Drugs, the Law on Administrative Penalties for Drug Rehabilitation and Post-Drug Rehabilitation on the Binh Dinh province area issued together with Decision 3510/QD-UBND in 2022, the Department of Planning and Investment has responsibilities in the implementation of post-drug rehabilitation management in Binh Dinh province as follows:

Coordinate with the Department of Labor, War Invalids and Social Affairs and relevant agencies to advise the Provincial People's Committee to balance and arrange public investment capital plans and other legal capital sources to implement the Plan.

What are the responsibilities of the Provincial People's Procuracy in the implementation of post-drug rehabilitation management in Binh Dinh province?

As prescribed in Subsection 10, Section IV of the Implementation Plan for Decree No. 116/2021/ND-CP dated December 21, 2021 of the Government detailing some articles of the Law on Prevention and Control of Drugs, the Law on Administrative Penalties for Drug Rehabilitation and Post-Drug Rehabilitation on the Binh Dinh province area issued together with Decision 3510/QD-UBND in 2022, the Provincial People's Procuracy has responsibilities in the implementation of post-drug rehabilitation management in Binh Dinh province as follows:

The People's Procuracy of the province shall chair, direct, and provide technical guidance to the People's Procuracy of the district in carrying out the work of reviewing the procedures for considering and deciding on the application of administrative measures at the People's Court of the district; and exercising the right to propose and appeal as prescribed by law.

What are the responsibilities of the People's Committees of districts, towns and cities in the implementation of post-drug rehabilitation management in Binh Dinh province?

As prescribed in Subsection 15, Section IV of the Implementation Plan for Decree No. 116/2021/ND-CP dated December 21, 2021 of the Government detailing some articles of the Law on Prevention and Control of Drugs, the Law on Administrative Penalties for Drug Rehabilitation and Post-Drug Rehabilitation on the Binh Dinh province area issued together with Decision 3510/QD-UBND in 2022, the People's Committees of districts, towns and cities have responsibilities in the implementation of post-drug rehabilitation management in Binh Dinh province as follows:

The Provincial People's Committee shall:

- Develop a plan for implementation at the local level; organize dissemination, dissemination, and propaganda to officials at all levels and people in the area;

- Organize training on Decree No. 116/2021/ND-CP and related documents for agencies and units in the area on identifying subjects, compiling application dossiers, and implementing decisions on the application of measures to send people to drug rehabilitation centers; work on drug rehabilitation at home and in the community and after-care management at place of residence;

- Implement the announcement of organizations and individuals with the necessary conditions to provide voluntary drug rehabilitation services at home and in the community in the area;

- Strengthen the direction of the work of managing drug addicts, illegal drug users, and aftercare, so as not to cause security and order problems caused by drug addicts and illegal drug users in the area; direct the Department of Labor, War Invalids and Social Affairs to coordinate with relevant agencies and units in the compilation of application dossiers and implementation of decisions on the application of measures to send people to drug rehabilitation centers;

- Encourage organizations and individuals in the area to participate in vocational training and job placement for people after drug rehabilitation, support people after drug rehabilitation to stabilize their lives, integrate into the community, and prevent relapse;

- Prioritize the allocation of funds from the local budget for drug rehabilitation, identification of drug addiction status, compilation of dossiers for sending people to drug rehabilitation centers, drug rehabilitation organization, and aftercare management;

- Direct the People's Committees of communes, wards, and towns to:

+ Compile application dossiers for application of measures to send people to compulsory drug rehabilitation centers, manage drug addicts according to regulations;

+ Implement aftercare management at the place of residence; support and create conditions for people after drug rehabilitation to stabilize their lives, integrate into the community, and prevent relapse;

+ Assign officials to manage, monitor, and support people who voluntarily rehabilitate at home and in the community; implement the issuance of a Certificate of Completion of Voluntary Drug Rehabilitation at Home and in the Community; ensure the regime and policies for those assigned to help manage drug addicts at home and in the community according to regulations;

+ Arrange locations and personnel to receive dossiers, guide the registration of voluntary drug rehabilitation; decide to voluntarily rehabilitate drug addicts at home and in the community, treat addiction to opiate drugs with substitute drugs.

All relevant agencies, localities, and units shall implement this Plan. Periodically every 6 months (before June 15), annually (before December 15), report on the results of implementation to the Department of Labor, War Invalids and Social Affairs for summary and report to the People's Committee of the province, the Ministry of Labor, War Invalids and Social Affairs according to regulations. In the process of implementation, if there are any difficulties and obstacles, please promptly reflect to the Department of Labor, War Invalids and Social Affairs for guidance or summarize, report to the People's Committee of the province for consideration and direction.
