What are the regulations on film classification in Vietnam?
Pursuant to Article 32 of the 2022 Law on Cinema (Effective January 1, 2023) on film classification, specifically as follows:
1. Films shall be classified according to their content for dissemination in accordance with the age of the viewer or shall not be allowed to be disseminated as follows:
a) Type P: Movies are allowed to be disseminated to viewers of all ages;
b) Type T18 (18+): Movies are disseminated to viewers who are at least 18 years of age;
c) Type T16 (16+): Movies are disseminated to viewers aged 16 or over;
d) Type T13 (13+): Movies are disseminated to viewers aged 13 or over;
đ/Type K: Movies which are disseminated to viewers under 13 years of age under the condition of watching with their parents or guardians;
e) Type C: Movies are not allowed to be disseminated.
2. The criteria for film classification shall apply generally to the forms of film dissemination prescribed by the Minister of Culture, Sports and Tourism.
What are the regulations on film deposition in Vietnam?
In Article 33 of the Law on Cinema 2022 (Effective from 01/01/2023), the regulations on film deposition as follows:
1. A cinematographic establishment that has a film for which a film classification permit has been granted according to regulations shall deposit 01 copy of the film with the film classification permit granting agency. For Vietnamese films used in the state budget, the script and materials attached to the film must be submitted.
2. The Vietnamese film storage period is 12 months from the date the film is granted the film classification permit; the import film storage period shall be as prescribed in the film classification permit.
3. At the end of the deposit period, the agency receiving the film deposit shall:
a) Transfer of unencrypted depository films, scripts and documents enclosed with the films to a film storage establishment for Vietnamese films produced using the state budget;
b) Transfer of depository film copies to the film storage establishments for Vietnamese films not produced using the state budget;
c) Return the deposited film to the filing establishment for imported film.
4. Cinema establishments must unlock the film for comparison and inspection at the request of the agency granting the film classification permit.
