What are the conditions for confirming the object as a war invalid to enjoy the benefits in Vietnam?

Pursuant to Article 37 of Decree 31/2013/ND-CP stipulating:

- Injured persons falling into one of the following cases are considered and confirmed as war invalids, people enjoying policies like these war invalids (hereinafter referred to as war invalids):

+ Fighting to protect independence, sovereignty, territorial integrity, national security;

+ Directly serving in combat while the enemy is attacking: Loading ammunition, providing first aid, evacuating the wounded, ensuring communication information, treating warehouse injuries, protecting goods and ensuring combat cases;

+ Revolutionary activities or resistance activities captured by the enemy, tortured but not yielding, resolutely fighting, leaving physical injuries;

+ Performing international duties while being injured in the line of duty.

- Cases of being injured while studying, sightseeing, traveling, convalescing, receiving medical treatment, visiting friends; working under economic, scientific, technical, cultural, educational, labor contracts are not considered and confirmed as war invalids;

+ Directly participating in the struggle against or preventing acts endangering society under crimes stipulated in the Penal Code;

+ Courageously performing urgent, dangerous tasks serving national defense, security; courageously rescuing people, rescuing state property and the people;

+ Directly performing combat training tasks or dangerous exercises serving national defense, security: Firing live ammunition, using explosives; training, conducting combat exercises of the air force, navy, coast guard, and special forces; firefighting; counterterrorism, riot control; hostage rescue; search and rescue, disaster response;

+ Performing national defense and security tasks in areas with particularly difficult economic and social conditions as prescribed by law;

+ While directly performing tasks to search for, collect and repatriate the remains of martyrs as assigned by competent authorities.

- War invalid confirmation is not considered for:

+ Cases of injuries caused by oneself or by violating laws, regulations of agencies, units;

+ Cases of injuries from December 31, 1994, and earlier, which have been concluded by competent authorities as not meeting the conditions for confirming war invalids or have resolved the labor accident regime.

The above are the cases confirmed as war invalids to enjoy preferential policies.
