What is the schdule for Lunar New Year 2025 holiday in Vietnam?
The Ministry of Labor, War Invalids and Social Affairs has issued Announcement 6150/TB-BLDTBXH 2024 regarding the Lunar New Year holiday, National Day holiday, Victory Day April 30, and International Labor Day May 1, 2025, for officials, public employees, and employees.
The official Lunar New Year holiday schedule for 2025 is as follows:
(1) Officials, public employees, and employees of administrative agencies, career organizations, political organizations, and socio-political organizations (hereafter referred to as officials and public employees) are allowed to be on holiday for the Lunar New Year 2025 from Saturday, January 25, 2025, (equivalent to December 26, the year of Giap Thin) until the end of Sunday, February 2, 2025, (equivalent to January 5, the year of At Ty). This includes 5 days of Lunar New Year holiday and 4 weekly days off.
(2) Agencies and units that do not operate on a fixed schedule of Saturdays and Sundays weekly will determine their specific program and plan to arrange appropriate holidays in conformity with the law.
(3) For employees not subjected to the provisions in clause 1 of Announcement 6150/TB-BLDTBXH 2024, the employer decides on the Lunar New Year 2025 holiday plan as follows:
Choosing 1 day at the end of the year of Giap Thin and 4 days at the start of the year of At Ty or 2 days at the end of the year of Giap Thin and 3 days at the start of the year of At Ty or 3 days at the end of the year of Giap Thin and 2 days at the start of the year of At Ty.
- Notify employees of the Lunar New Year 2025 holiday plan at least 30 days prior to implementation.
- If a weekly day off coincides with a holiday, a Tet holiday stipulated in clause 1, Article 112 of Labor Code 2019, employees are entitled to a compensatory day off following the holiday, according to clause 3, Article 111 of Labor Code 2019.
Thus, according to the official Lunar New Year 2025 schedule, officials and public employees will have a continuous 9-day holiday from January 25, 2025, to February 2, 2025 (December 26, the year of Giap Thin - January 5, the year of At Ty).
For employees in private enterprises, the employer decides on the Lunar New Year 2025 holiday plan as follows: 1 day at the end of the year of Giap Thin and 4 days at the start of the year of At Ty or 2 days at the end of the year of Giap Thin and 3 days at the start of the year of At Ty or 3 days at the end of the year of Giap Thin and 2 days at the start of the year of At Ty.
Additionally, the Ministry of Labor, War Invalids and Social Affairs encourages employers to apply the same Lunar New Year 2025 holiday period for employees as that provided to officials and public employees.
What are regulations on salary of employees working on the 1st day of the Lunar New Year 2025 in Vietnam?
Pursuant to Article 112 of the Labor Code 2019 on holiday:
Article 112. Holidays
- Employees are entitled to time off work and full pay during the following holidays and Tet:
a) New Year's Day: 1 day (January 1 of the Gregorian calendar);
b) Lunar New Year: 5 days;
c) Victory Day: 1 day (April 30 of the Gregorian calendar);
d) International Labor Day: 1 day (May 1 of the Gregorian calendar);
e) National Day: 2 days (September 2 of the Gregorian calendar and 1 adjacent day);
f) Hung Kings' Commemoration Day: 1 day (tenth day of the third lunar month).
According to Article 98 of the Labor Code 2019 on overtime wages and night work pay:
Article 98. Overtime Wages, Night Work Pay
- employees working overtime are entitled to wages calculated on the wage unit price or the actual wage for the current job as follows:
a) On regular days, at least 150%;
b) On weekends, at least 200%;
c) On holidays, Tet, days off with pay, at least 300%, excluding the holiday, Tet wage, and paid day off for wage earners.
- Employees working at night are paid an additional amount of at least 30% of the wage calculated from the wage unit price or actual wage for the regular working day.
- Employees working overtime at night are, in addition to being paid according to clauses 1 and 2 of this Article, entitled to a further 20% of the wage calculated from the wage unit price or according to the daily work for daytime, weekly time-off day, or holiday, Tet day.
- The Government of Vietnam stipulates the details of this Article.
Based on the above regulations, during the Tet holiday as stipulated, employees are entitled to a 5-day holiday. Therefore, if employees work on the 1st Day of the Lunar New Year 2025, their wages are calculated as follows:
If employees perform overtime during Lunar New Year, they are entitled to at least 300% of their wages, excluding the holiday, Tet wage, and paid day off for wage earners.
If employees perform overtime at night during the Lunar New Year, they are entitled, in addition to the overtime pay during holidays, Tet, and night work pay, to a further 20% of the wage calculated from the wage unit price or the daily work for daytime, weekly day off or holiday, Tet day.
