What are regulations on handling search results and collection of martyrs' remains regarding collective martyrs' remains in Vietnam?
Pursuant to Clause 2 and 3, Article 16 of Circular 80/2022/TT-BQP (effective from December 26, 2022) stipulating regulations on handling search results and collection of martyrs' remains regarding collective martyrs' remains in Vietnam as follows:
2. For the remains of mass martyrs' graves
a) When searching and gathering without determining the exact number of martyrs' remains, identity and relics of each martyr, the assembled martyr's remains shall be buried together in the mass grave (not divided into the grave of the deceased). separate each set of remains and register each martyr if there are not enough grounds to conclude);
b) Based on the list of martyrs provided by units, localities, veterans who have participated in combat in the area (if any) and management records, the Policy Department, the General Department of Politics shall coordinate with the Department of People with meritorious services, the Ministry of Labor, War Invalids and Social Affairs shall appraise and agree on a list to write the names of martyrs on the common gravestone.
3. In case there is a relic but there is no basis to confirm the information of the martyr, the search and collection unit shall compile a dossier of gathering according to regulations and report it to the provincial-level Military Command or the unit commander, that is assigned the task of searching and gathering martyrs' remains, to coordinate with relevant agencies and units in verifying and making conclusions; if there are enough grounds to determine that it is a martyr's grave and it has just been unloaded for the first time, it shall be agreed and handed over to the Labor - Invalids and Social Affairs sector for burial according to regulations. In case of failure to verify and conclude information about martyrs and martyrs' graves, it shall be reported to Steering Committees at all levels for consideration and settlement according to their competence.
What are regulations on making a profile of searched and collected martyrs' remains in Vietnam?
Pursuant to Article 17 of Circular 80/2022/TT-BQP (effective from December 26, 2022) stipulating regulations on making a profile of searched and collected martyrs' remains in Vietnam as follows:
1. Requirements, responsibilities
After the remains of martyrs are searched and gathered, they must make a management file; representatives of the local authorities where searching, gathering and the commander of the unit in charge of searching and gathering martyrs' remains signed for certification.
2. A file of searchable and collected martyrs' remains includes:
a) A form providing information about martyrs and martyrs' graves (form No. 01);
b) Map, coordinates surveying information on martyrs' graves;
c) Location map of martyrs' graves;
d) Minutes of collecting martyrs' remains (form No. 02);
dd) Photographs (color photos) when discovering martyrs' remains and photos of martyrs' remains and relics when they are unloaded;
e) Statistics on martyrs' remains and remains (form No. 03);
g) Relevant documents (grave chart, death notice...);
h) Table of contents for searching and gathering martyrs' remains.
In case the remains of martyrs are gathered abroad, the above documents must be made in two languages (Vietnamese version and the local language version).
3. The file of searchable martyr's remains, gathered in Clause 2 of this Article, is made in 02 sets (by the agency or unit directly handing over and the agency or unit receiving the martyr's remains, each agency or unit keeps 01 set).
What are content of handing over the remains of martyrs in Vietnam?
Pursuant to Article 18 of Circular 80/2022/TT-BQP (effective from December 26, 2022) stipulating content of handing over the remains of martyrs in Vietnamas follows:
1. Minutes of handover of martyrs' remains, made according to Form No. 81, Appendix I of Decree No. 131/2021/ND-CP, enclosed with dossiers and lists of martyrs; dossiers on searching and gathering martyrs' remains according to Clause 2, Article 17 of this Circular.
2. Hand over the remains and relics of each martyr (if any) according to the provisions of Article 143 of Decree No. 131/2021/ND-CP.
