What are regulations on conditions and criteria for resistance activists infected with toxic chemicals in Vietnam?

Article 29 of the Ordinance on Incentives for People with Meritorious Services to the Revolution 2020 stipulates conditions and criteria for resistance activists infected with toxic chemicals as follows:

1. The person who worked, fought, served in combat during the period from August 1, 1961 to April 30, 1975 in the area where the US military used toxic chemicals in battlefield B, C, K and a number of places in Vinh Linh district, Quang Tri province are contaminated with toxic chemicals, leading to one of the following cases, they will be issued by the competent authority "Certificate of resistance activists infected with toxic chemicals":

a) Having a disease related to exposure to toxic chemicals with an injury rate of 21% or more;

b) Infertility;

c) Giving birth to a deformed or deformed child.

2. The Government shall detail the place names in Vinh Linh district, Quang Tri province and the List of diseases, deformities and malformations related to exposure to toxic chemicals specified in this Article.

What are preferential regimes for resistance activists infected with toxic chemicals in Vietnam?

Article 30 of the Ordinance on Incentives for People with Meritorious Services to the Revolution 2020 also stipulates preferential regime for resistance activists infected with toxic chemicals as follows:

1. Monthly allowances for resistance activists infected with toxic chemicals are as follows:

a) Persons falling into the cases specified at Point a, Clause 1, Article 29 of this Ordinance are entitled to a monthly allowance based on the body injury rate at levels ranging from 21% to 40%, from 41% to 60 %, from 61% to 80% or from 81% or more;

b) Persons who fall into the cases specified at Point b or c, Clause 1, Article 29 of this Ordinance, but do not suffer from diseases or suffer from diseases specified at Point a, Clause 1, Article 29 of this Ordinance with an injury rate below 61% are entitled to a monthly allowance similar to those with an injury rate of between 41% and 60%; In case of a disease with an injury rate of 61% or more, they are entitled to a monthly allowance corresponding to the rate of bodily injury from 61% to 80% or from 81% or more specified at Point a this Clause;

c) Sick soldiers suffering from additional diseases specified at Point a, Clause 1, Article 29 of this Ordinance due to poisoning with toxic chemicals are entitled to general examination and assessment to receive a monthly allowance corresponding to the body injury rate;

d) Sick soldiers in the cases specified at Point b or c, Clause 1, Article 29 of this Ordinance are entitled to a monthly allowance for sick soldiers and a monthly allowance for resistance activists infected with toxic chemicals have a body injury rate from 41% to 60%;

dd) Sick soldiers who suffer from additional diseases specified at Point a, Clause 1, Article 29 of this Ordinance due to poisoning with toxic chemicals and fall into the cases specified at Points b or c, Clause 1, Article 29 of this Ordinance are eligible to receive monthly payment as prescribed at point c or point d of this clause.

2. Monthly allowance for resistance activists infected with toxic chemicals with an injury rate of 81% or more.

3. Service worker allowance for resistance activists infected with toxic chemicals with a body injury rate of 81% or more living at home.

4. Health insurance.

5. Nursing rehabilitation every two years; cases with a body injury rate of 81% or more are annually rehabilitated by nurses.

6. The preferential regime specified at Points c, e, g, h, i and k, Clause 2, Article 5 of this Ordinance.

Preferential regime for relatives of resistance activists infected with toxic chemicals in Vietnam

The preferential regime for relatives of resistance activists infected with toxic chemicals is specified in Article 31 of the Ordinance on Incentives for People with Meritorious Services to the Revolution 2020:

1. Monthly allowance for birth defects, deformities related to exposure to toxic chemicals with an injury rate of 61% or more.

2. Health insurance for the following people:

a) Natural father, mother, spouse, children from full 6 years old to under 18 years old or from full 18 years old if they continue to go to school or suffer from severe disability, especially severe disability of resistance activists infected with toxic chemicals with an injury rate of 61% or more;

b) Natural children specified in Clause 1 of this Article;

c) People serving resistance activities infected with toxic chemicals with an injury rate of 81% or more live at home.

3. When resistance activists are infected with toxic chemicals and die with an injury rate of 61% or more, their relatives are entitled to a survivorship allowance as follows:

a) Natural father, natural mother, spouse who is full age as prescribed in Clause 2, Article 169 of the Labor Code, children under 18 years of age or full 18 years of age if they continue to go to school or are severely disabled, especially severe disabilities are entitled to a monthly survivorship allowance;

b) Natural father and mother living alone, spouse who is full age as prescribed in Clause 2, Article 169 of the Labor Code living alone, orphaned child with both parents under 18 years old or full 18 years old if they continue to go to school or suffer from severe disability, especially severe disability, they are entitled to monthly survivorship allowance and monthly maintenance allowance.

4. The preferential regime specified at Point c, Clause 2, Article 5 of this Ordinance for natural children specified in Clause 1 of this Article.

5. The preferential regimes specified at Points d and dd, Clause 2, Article 5 of this Ordinance for children of resistance activists infected with toxic chemicals.

6. Lump-sum allowance for relatives at the level of 3 months of current monthly allowance when resistance activists are infected with toxic chemicals, and their biological children currently receiving monthly allowances die.

7. Funeral allowance for the person or organization performing the funeral in the following cases:

a) Resistance activists infected with toxic chemicals who are enjoying monthly allowance die;

b) The biological child specified in Clause 1 of this Article dies.
