Principles of establishing records and time limits for settlement in the management of records of people with meritorious services in Vietnam
Based on Article 126 of Decree 131/2021/ND-CP (effective from February 15, 2022), the principles of establishing records and time limits for settlement in the management of records of people with meritorious services in Vietnam are stipulated as follows:
- Each administrative procedure must submit one set of required documents as specified in this Decree.
- The documents in the application file must be original, and in cases where copies or authenticated copies are used, specific regulations for each administrative procedure must be followed.
- The implementation of administrative procedures specified in this Decree can be done directly or by mail.
- Within the time limit specified in this Decree, if the file does not meet the conditions for consideration and settlement, the agency handling the file must provide a written response stating the reason.
- The files of people with meritorious services transferred by agencies and units to the Ministry of Labor - Invalids and Social Affairs for the implementation of preferential regimes, and the files managed and implemented by the Department of Labor - Invalids and Social Affairs where the person with meritorious services is permanently residing, must consist of one set of original files as regulated.
The original file is a file that includes documents specified by the competent authority when conducting the recognition procedure and settlement of preferential regimes for people with meritorious services.
Copies of the files of people with meritorious services that have been used as a basis for granting support to their relatives before the effective date of this Decree still have validity.

Management of files of people with meritorious services in Vietnam
Article 128 of Decree 131/2021/ND-CP (effective from February 15, 2022) regulates the management of files of people with meritorious services as follows:
- The Ministry of National Defense and the Ministry of Public Security are responsible for:
+ Managing the files of people with meritorious services who are in active service or working.
+ Directing the issuance of replacement records for cases where the disabled veteran files recognized before December 31, 1994, are incomplete according to the regulations (due to loss).
- The Ministry of Labor - Invalids and Social Affairs is responsible for:
+ Managing the Decision of the Prime Minister on granting the "Fatherland Merit" Certificate.
+ Directing the issuance of replacement records for cases where the martyr files recognized before December 31, 1994, are incomplete according to the regulations (due to loss).
- The Department of Labor - Invalids and Social Affairs is responsible for:
+ Receiving and registering the management of files of people with meritorious services in the localities where they are permanently residing.
+ Establishing and issuing replacement records for people with meritorious services according to the regulations in Forms 95, 96, 97, 98, 99.
+ Updating information about people with meritorious services and their family members under management into the national database on people with meritorious services.
+ The Ministry of National Defense, the Ministry of Public Security, and the Department of Labor - Invalids and Social Affairs shall report annually on the number of people with meritorious services being managed from January 1 to December 31 of the year, according to Form 100 Appendix I of this Decree, to be submitted to the Ministry of Labor - Invalids and Social Affairs before January 31 of the following year.
+ The management and storage of files about people with meritorious services must comply with the principles specified in the Archives Law.
+ The files of people with meritorious services must be permanently stored at the competent authority according to this Article.
