What are penalties for parents to abandon children in Vietnam? My name is Lam, I am 25 years old this year. My aunt just picked up a baby near my hometown temple. I have brought it to the competent authority. I am very upset with this behavior, so I want to ask what are penalties for this behavior?
What are penalties for parents to abandon children in Vietnam?
Pursuant to Article 27 of the 2016 Law on Children stipulating right to be protected against violence, neglect or abandonment as follows:
Children have the right to be protected, in any form, from violence, neglect or abandonment which harms their comprehensive development.
Pursuant to Article 21 of Decree 130/2021/ND-CP stipulating violation of regulations on caring and nurturing children as follows:
1. A fine ranging from VND 10.000.000 to VND 15.000.000 shall be imposed on:
a) Either parent or caregiver of children who fails to fulfill their obligations and responsibilities in caring, nurturing children except for cases where such individuals must be isolated from the children or the children are under adoption as per the law;
b) Either parent or caregiver of children who fails to care, nurture the children, neglect their obligations and responsibilities in caring, nurturing children or abandoning children or severing emotional and financial support for children or forcing children to live away from the family, except for cases where either parent or caregiver must temporarily be isolated from the children or the children are under adoption as per the law.
2. A fine ranging from VND 20.000.000 to VND 25.000.000 shall be imposed on parent or caregiver who intentionally abandons children.
Thus, according to the current law in Vietnam, when parents leave their children to live on their own, forcing the children not to live with their families, they will be administratively sanctioned up to 15,000,000 VND. For acts of intentionally abandoning children will be fined from 20,000,000 to 25,000,000 VND.
