What are penalties for hurting the honor and dignity of family members in Vietnam? What are penalties for prohibiting family members from going out of their house to meet their relatives, friends in Vietnam? 

My neighbors often scold their children badly, it will negatively affect the children's image at school, will my neighbors be punished?

1. What are penalties for hurting the honor and dignity of family members in Vietnam?

Pursuant to Article 54 of Decree 144/2021/ND-CP stipulating acts of defamation of family members as follows:

1. A fine of from VND 5.000.000 to VND 10.000.000 shall be imposed for insulting, nagging or hurting the honor and dignity of family members.

2. A fine of from VND 10.000.000 to VND 20.000.000 shall be imposed for any of the following violations:

a) Disclosing or distributing materials or documentation of privacy of family members to hurt the honor and dignity;

b) Using the media to hurt the honor and dignity of family members;

c) Disseminating and distributing the leaflets, articles, photos or sounds to hurt the honor and dignity of family members;

3. Remedial measures:

a) Mandatory public apology upon the victim’s requirement for the acts specified in Clauses 1 and 2 of this Article;

b) Mandatory withdrawal of leaflets, articles, photos or sounds for the acts specified at Points a and c Clause 2 of this Article;

Thus, persons who hurt the honor and dignity of family members in Vietnam will be fined from VND 5 million to VND 20 million depending on the case. In addition, the violator is also forced to take remedial measures due to the above violation.

2. What are penalties for prohibiting family members from going out of their house to meet their relatives, friends in Vietnam? 

Pursuant to Clause 1, Article 55 of Decree 144/2021/ND-CP stipulating isolating, shunning or psychologically putting pressure as follows:

1. A warning or a fine of from VND 5.000.000 to VND 10.000.000 shall be imposed for any of the following violations:

a) Prohibiting family members from going out of their house, preventing family members from meeting with their relatives, friends or having legitimate and healthy social relations aimed at isolating or psychologically putting pressure on those members;

b) Prohibiting the family members from exercising the right to work;

c) Prohibiting the family members from participating healthy and legitimate social activities;

Thus, those who forbid family members from going out of their house to meet friends and relatives may be subject to a warning or a fine of between VND 5,000,000 and 10,000,000. In addition, the violator is also required to make a public apology when the victim requests for the violation in Vietnam.

In the above case, your neighbor will be fined from 5 million VND to 20 million VND depending on the case. In addition, violators are also forced to take remedial measures due to their violations according to Clause 3, Article 54 of Decree 144/2021/ND-CP.
