Article 3. Interpretation of Terms
In this Decree, the following terms are understood as follows:
- Fireworks are products that contain firework chemicals, which, when subjected to mechanical, thermal, chemical, or electrical stimulation, cause rapid and strong chemical reactions, generate gases, create sound, light, and color effects in space, and may cause explosions or not. Fireworks include explosive fireworks and non-explosive fireworks.
a) Explosive fireworks are products manufactured manually or industrially, which, when subjected to mechanical, thermal, chemical, or electrical stimulation, cause noises or produce whistling sounds, bangs, and color effects in space;

Low-level explosive fireworks have a shell diameter not exceeding 90 mm or a shooting range not exceeding 120 m. High-level explosive fireworks have a shell diameter greater than 90 mm or a shooting range exceeding 120 m;
b) Non-explosive fireworks are products manufactured manually or industrially, which, when subjected to mechanical, thermal, chemical, or electrical stimulation, create sound, light, and color effects in space without causing explosions.

Pursuant to point b, clause 2; point a, clause 7; point b, clause 8, Article 11 of Decree 144/2021/ND-CP specifying the level of penalties for violations regarding the management and use of weapons, explosive materials, explosive precursors, support tools, fireworks, and prohibited dangerous toys:

b) Seizing, exchanging, buying, selling, gifting, borrowing, renting, lending, pawning, receiving pawn of licenses, confirmations, certificates, and permits for weapons, support tools, and fireworks;

a) Confiscation of the exhibits and means of administrative violations for violations specified in points d and dd clause 1; points a, b, c, e, and g clause 2; points a, c, d, dd, e, h, i, and k clause 3; points a, b, c, d, dd, e, h, and i clause 4 and clause 5 of this Article;

Thus, individuals who buy fireworks produced by the Ministry of Defense for sale shall be fined from 2,000,000 VND to 5,000,000 VND, have the exhibits and means of administrative violations confiscated, and shall be required to return the illegal profits obtained from committing the administrative violation.
Note: The above-mentioned fine is applied to administrative violations by individuals. For organizations committing the same violations, the fine shall be double the fine applicable to individuals. (Regulated in clause 2, Article 4 of Decree 144/2021/ND-CP)
