Are detainees in Vietnam allowed to read religious scriptures?
Pursuant to Article 6 of the 2016 Law on Belief and Religion on the freedom of belief, religion of everyone:
Article 6. Freedom of Belief, Religion of Everyone
- Everyone has the right to freedom of belief and religion, following or not following any religion.
- Each person has the right to express religious beliefs, perform religious rituals, participate in festivals, study and practice religious doctrines and laws.
- Each person has the right to enter religious life at religious establishments, study at religious training institutions, and training classes of religious organizations. Minors entering religious life or studying at religious training institutions must have the consent of parents or guardians.
- Religious dignitaries and clergy have the right to perform religious rituals, preach, and minister at religious establishments or other legal locations.
- Detainees and pre-trial detainees as prescribed by law on temporary detention, persons serving prison sentences, persons serving educational measures at reformatory schools, compulsory education institutions, and compulsory detoxification centers have the right to use religious scriptures and express religious beliefs.
- The Government of Vietnam specifies the detailed assurance of implementing the rights stipulated in Clause 5 of this Article.
According to the above provisions, detainees have the right to use religious scriptures and express religious beliefs.
When is an organization in Vietnam granted a Certificate of Religious Activity Registration?
Pursuant to Article 18 of the 2016 Law on Belief and Religion on the conditions under which an organization is granted a religious activity registration certificate:
[1] Have religious doctrines, laws, and rituals
[2] Have purposes, missions, and operational regulations not contrary to legal provisions
[3] The organization's name does not duplicate the name of an existing registered religious organization, political organization, socio-political organization, or the name of a famous person or national hero
[4] The representative or leader of the organization is a Vietnamese citizen residing in Vietnam, with full civil act capacity; not under any administrative handling measures in the field of belief and religion; free of criminal records or not under prosecution in accordance with criminal procedure laws
[5] Possess a legal location to place headquarters
[6] The content of religious activities does not fall under the following cases:
- Discrimination, or bias due to belief, religion
- Coercion, bribery, or obstruction of others in following or not following beliefs, religions
- Insulting beliefs, religions
- Religious activities that:
+ Infringe national defense, security, national sovereignty, public order, safety, environment
+ Violate social ethics; infringe upon the body, health, life, or property; insult the dignity and honor of others
+ Obstruct the execution of citizen rights and obligations
+ Cause division among ethnicities; cause division among religions; divide people following different beliefs, religions, or between believers and non-believers
- Exploiting religious activities for profiteering
