Are foreigners working in Vietnam entitled to days off on Lunar New Year?
Based on Article 112 of the Labor Code 2019 regarding holidays:
Article 112. Holidays
- Employees are entitled to leave with full pay on the following holidays and Tet:
a) New Year's Day: 01 day (January 01 of the solar calendar);
b) Lunar New Year: 05 days;
c) Victory Day: 01 day (April 30 of the solar calendar);
d) International Labor Day: 01 day (May 01 of the solar calendar);
dd) National Day: 02 days (September 02 of the solar calendar and 01 day immediately preceding or following);
e) Hung Kings' Commemoration Day: 01 day (10th of March of the lunar calendar).
- Foreign employees working in Vietnam, in addition to the holidays specified in clause 1 of this Article, are also entitled to one traditional holiday and one National Day of their country.
- Annually, based on actual conditions, the Prime Minister of Vietnam decides on the specific holidays mentioned at points b and đ of clause 1 of this Article.
According to the above regulation, foreigners working in Vietnam are entitled to leave with full pay on the following holidays:

Therefore, foreigners working in Vietnam are entitled to leave with full pay on the Lunar New Year.
How many annual leave days do employees in Vietnam have?
Based on Article 113 of the Labor Code 2019, employees who have worked for a full 12 months for an employer are entitled to annual leave with full pay as per their labor contract as follows:
- 12 working days for those working under normal conditions;
- 14 working days for minors, employees with disabilities, those in labor-intensive, toxic, or dangerous jobs;
- 16 working days for those engaged in particularly heavy, toxic, or dangerous jobs.
Note: For every 05 years of working for an employer, employees are entitled to an additional 01 day of annual leave.
