What are rights and obligations of children in marriage and family in Vietnam?
Pursuant to Article 70 of the Law on Marriage and Family 2014, the rights and obligations of children are stipulated as follows:
- To be loved and respected by parents, granted lawful personal and property rights and interests as prescribed by law; to receive education; and to develop healthily in physical, intellectual, and moral aspects.
- To have the duty of cherishing, respecting, being grateful to, filial to, and caring for parents, and preserving the family's honor and fine customs and traditions.
- Minor children, adult children who lose civil act capacity or cannot work and have no property to support themselves have the right to live with their parents and be looked after, reared, and cared for by their parents.
- Minor children are to participate in family work appropriate to their age and not contrary to the provisions of law on the protection, care, and education of children.
- Adult children have the right to freely choose a profession, place of residence, study, and raise their cultural, professional, and vocational levels; to participate in political, economic, cultural, and social activities according to their aspirations and capabilities. When living with parents, children have the obligation to participate in family work, labor, production, and create income to ensure the family's common life; contribute income to meet family needs consistent with their abilities.
- To enjoy property rights commensurate with their labor contributions to the family's property.
Who is the legal representative of children in Vietnam?
Pursuant to Article 73 of the Law on Marriage and Family 2014, the representative of children is stipulated as:
Article 73. Representation for Children
- Parents are the legal representatives of their minor children, adult children who lose civil act capacity unless the children have other guardians or other legal representatives.
- Either parent has the right to independently carry out transactions to meet the essential needs of minor children, adult children who lose civil act capacity, or cannot work and have no property to support themselves.
- For transactions related to property being real estate, registered movable assets, the business assets of minor children, adult children who lose civil act capacity, the agreement of both parents is required.
- Parents shall jointly take responsibility for performing transactions related to their children's assets as prescribed in Clauses 2 and 3 of this Article and as per the Civil Code.
According to the above provision, parents are the legal representatives of their minor children, unless the children have other guardians or other legal representatives.
