The Ministry of Information and Communications of Vietnam amends the forms used in radio and television service activities from August 15, 2023
On June 30, 2023, the Ministry of Information and Communications issued the Circular 05/2023/TT-BTTTT amending and supplementing a number of articles of Circular 19/2016/TT-BTTTT on registration forms, application for issuance of License, Certificate, License and professional report as prescribed in Decree 06/2016/ND-CP on management, provision and use of high school services.
As prescribed in the Circular 05/2023/TT-BTTTT, there are 08 amended forms and 03 supplemented forms on management, provision and use of radio and television services. Specifically:
08 forms on management, provision and use of radio and television services have been amended, including:
- Form No. 01/DVTHTT: An application form for a license to provide pay radio and television services;
- Form No. 02/DVTHTT: License to provide pay radio and television services
- Form No. 05/DVTHTT: Declaration of registration, registration to amend and supplement the list of program channels on pay radio and television services
- Form No. 06/DVTHTT: Certificate of registration for the list of channels on pay radio and television services
- Form No. 07/DVTHTT: Declaration of registration to receive foreign television signals directly from satellites
- Form No. 13/SXCT: License to produce domestic radio and television program channels
- Form No. 15/BTCT: License to produce domestic radio and television program channels
- Form No. 16A/SXCT: Report on production, editing and translation of content as required
03 forms on management, provision and use of radio and television services have been supplemented, including:
- Form No. 09A/DVTHTT: Periodic report on content provision activities - on radio and television services
- Form No. 10A/DVTHTT: Monthly report on content provision activities on pay radio and television services
- Form No. 10B/DVTHTT: Make a profile to track content on on-demand services, value-added services and advertising.
What is the time limit for enterprises licensed to provide pay radio and television services in Vietnam to submit monthly reports?
Pursuant to Clause 4.b Article 4 of the Circular 19/2016/TT-BTTTT (amended by Clause 2 Article 1 of the Circular 05/2023/TT-BTTTT) stipulating the time limit for enterprises licensed to provide pay radio and television services in Vietnam to submit monthly reports as follows:

4a. Every six months, enterprises licensed to provide pay radio and television services are responsible for reporting on the provision of content on radio and television services to the Radio and Television Administration and electronic information using form No. 09A/DVTHTT specified in Article 2 of this Circular. The deadline for submitting reports for the first six months of the year is June 6 of the reporting year and the annual report, and November 25 of the reporting year at the latest.
4b. Every month, businesses that are granted a license to provide pay radio and television services are responsible for making a quick report on the provision of content on radio and television services to the Department of Radio, Television and Electronic Information using form No. 10A/DVTHTT specified in Article 2 of this Circular. The deadline for submitting the report is fast, no later than the 15th of the reporting month.
4c. Every six months, press agencies that are granted a license to produce domestic program channels are required to produce, edit and translate content upon requests are responsible for reporting on the production, editing and translation of content upon request to the Department of Radio, Television and Electronic Information using form No. 16A/SXCT specified in Article 2 of this Circular. The deadline for submitting reports for the first six months of the year is June 6 of the reporting year and the annual report, and November 25 of the reporting year at the latest.
4d. Professional reports of agencies and enterprises shall be sent by one of the following methods to the Department of Radio, Television and Electronic Information: directly, by post, online on the reporting system at the website of the Department of Radio, Television and Electronic Information
Thus, the enterprise is granted a license to provide pay radio and television services must send a quick report on the provision of content on radio and television services to the Department of Radio, Television and Electronic Information within the 15th day of the reporting month at the latest.

What is the validity period of the license to provide pay radio and television services in Vietnam?
Pursuant to Clause 4, Article 12 of Decree 06/2016/ND-CP stipulating the validity period of a license to provide pay radio and television services as follows:

4. License Term
a) A license to provide pay radio and television services is valid for a maximum of 10 (ten) years from the date of issue but does not exceed the validity period stated in the License to establish telecommunications networks or written agreement on lease and use of telecommunications network infrastructure for the services specified at Points a, b, c, d, Clause 1, Article 4 of this Decree; confirm the registration of the domain name “.vn” or the specified Internet address for the service specified at Point dd, Clause 1, Article 4 of this Decree;
b) After 01 (one) year from the effective date of the License, if the licensed enterprise fails to provide pay radio and television services, the License is no longer valid. The Ministry of Information and Communications is responsible for issuing the decision to revoke the License;
If the enterprise wants to continue providing services, the enterprise must carry out the dossiers and procedures for re-grant of the license like the dossiers and procedures for the first-time grant of a license specified in Clauses 2 and 3 of this Article.
Thus, the license to provide pay radio and television services has a maximum term of 10 years from the date of issuance.
However, the validity period stated in the license to establish telecommunications network or the written agreement on lease and use of telecommunications network infrastructure for terrestrial television services, cable television, television via satellite, and mobile television; confirm registration of domain name “.vn” or specified Internet address for radio and television services on the Internet.
Note: Circular 05/2023/TT-BTTTT takes effect from 15/8/2023.
