What are regulations on alternative care for children by individuals and families who are relatives in Vietnam?

Pursuant to Clause 3, Article 10 of Circular 14/2020/TT-BLDTBXH regulating alternative care for children by individuals and families who are relatives as follows:

a) On the basis of assessing the child's condition and preparing the child's profile, the commune-level child protection officer prepares a list of the child's relatives and evaluates the condition of the child's relatives and choose relatives who are eligible to receive alternative child care according to the provisions of law;

b) Commune-level child protection workers notify the child's situation to individuals and families who are relatives of the child; Mobilize individuals and families to receive alternative care for children;

c) In cases where an individual or family is a child's relative who does not reside in the same commune as the child, the person in charge of child protection at the commune level advises the People's Committee of the commune where the child resides, coordinate with the commune-level People's Committee where individuals and families who are the children's relatives reside to carry out procedures to support children receiving alternative care;

d) In cases where children are being cared for by relatives, commune-level child protection workers shall guide individuals and families to register with the Commune-level People's Committee of their place of residence regarding alternative care for children;

d) Commune-level child protection workers advise or connect consulting services for individuals and families receiving alternative care who are relatives of children on legal regulations related to rights, children's responsibilities, child protection and alternative care skills;

e) The Commune-level People's Committee issues a decision to hand over children to individuals or families of relatives to take care of the children instead;

g) Commune-level child protection workers coordinate with agencies, organizations and individuals to support children in accessing services as prescribed in Clause 2, Article 4 of this Circular;

h) People working in commune-level child protection support individuals and families receiving alternative care for children to complete documents and procedures to ensure that children receive full support policies according to regulations under the law.

What are regulations on alternative care for children by individuals or families other than relatives in Vietnam?

Pursuant to Clause 4, Article 10 of Circular 14/2020/TT-BLDTBXH regulating alternative care for children by individuals and families who are not relatives as follows:

a) Based on the assessment of the circumstances, status, needs and wishes of children in need of alternative care, commune-level child protection workers select individuals and families to receive appropriate alternative care for children; report verifying the individual and family receiving alternative care according to the provisions of Article 42 of the Law on Children and Article 7 of this Circular;

b) Commune-level child protection workers notify children's information about their physical health, mental health, learning situation, family situation and other information (if applicable) for individuals and families to receive respite care;

c) Children are allowed to contact and get acquainted with individuals and families receiving alternative child care at least twice before receiving alternative care.

d) Commune-level child protection workers are responsible for submitting to the Chairman of the Commune-level People's Committee where the individual or family receiving alternative care resides to issue a Decision on handing over and receiving children to the individual or family. Families receive alternative care when the individual or family meets the conditions prescribed by law and is suitable for the child.

d) In case the individual or family receiving alternative care does not reside in the same commune as the child, the person in charge of child protection at the commune level shall advise the Commune-level People's Committee of the place of residence of the child and coordinate with the commune-level People's Committee of the place of residence of the individual or family receiving alternative care to carry out delivery procedures as prescribed in Clause 7, Article 42 of Decree No. 56/2017/ND-CP;

e) Commune-level child protection workers assist in completing procedures so that children and individuals and families receiving alternative care can receive support policies as prescribed in Clause 2, Article 4 of this circular.
