Pursuant to Article 86 of Decree 131/2021/ND-CP (Effective from February 15, 2022) stipulating procedures and processes for resolving health recovery nursing regimes for people with meritorious services as follows:

- The Commune People's Committee, based on the health status of the subject, prepares a list of people to receive centralized nursing and home nursing according to Form No. 86, Appendix I of this Decree in the first quarter of the year and sends it to the Department of Labor, War Invalids and Social Affairs.

- The Department of Labor, War Invalids and Social Affairs, within 12 days from the date of receiving the list from the Commune People's Committee, is responsible for synthesizing the list according to Form No. 86 Appendix I of this Decree and sending it to the Department of Labor, War Invalids and Social Affairs.

- Department of Labor, War Invalids and Social Affairs within 30 days from the date of receiving the comprehensive list of the Department of Labor, War Invalids and Social Affairs, based on the assigned estimate and the list to approve the list of centralized and home nurses and issue a decision according to Form No. 68 Appendix I of this Decree.

- The Ministry of National Defense and the Ministry of Public Security guide the process of implementing health recovery nursing regime for cases being managed by the military and police in accordance with actual conditions. The review and resolution time must not exceed 40 days from the date of receipt of the list from the requesting agency or unit.

What are regulations on organization implementing the nursing regime to recover health to people with meritorious services in Vietnam?

Article 87 of Decree 131/2021/ND-CP (Effective from February 15, 2022) stipulates organization and implementation of health recovery nursing regime for people with meritorious services as follows:

- Home nurses make direct payments to beneficiaries.

- Nurses focus on implementing the following:

+ Based on the actual conditions in the locality, the Director of the Department of Labor, War Invalids and Social Affairs decides on the specific nursing time (a period of 5 to 10 days, excluding travel and return time); Organize implementation or delegate to the Department of Labor, War Invalids and Social Affairs to organize centralized nursing implementation.

+ In cases where the subject does not continue to perform centralized nursing for objective reasons, the Department of Labor, War Invalids and Social Affairs shall pay the nursing facility for meals and expenses based on the number of days. In fact, for nursing subjects at the nursing facility, except for expenses for medicine and gifts that are settled as for subjects traveling in full, the Department of Labor, War Invalids and Social Affairs recovers the remaining funds to pay to the state budget. In case the subject has been convalescing for less than 30% of the nursing period, the Director of the Department of Labor, War Invalids and Social Affairs shall consider and decide or delegate the Department of Labor, War Invalids and Social Affairs to decide on nursing in the next session.

+ Based on the nursing scale of the affiliated nursing facility, the number of concentrated nursing subjects, and the current spending level, the Department of Labor, War Invalids and Social Affairs assigns centralized nursing tasks, allocates and assigns Estimates for affiliated nursing facilities to implement centralized nursing funding locally.

+ In case nursing is concentrated in the locality but is performed by an accommodation facility outside the Department of Labor, War Invalids and Social Affairs, or nursing is concentrated in another locality, the Department of Labor, War Invalids and Social Affairs shall perform it. Withdraw estimates to make payments according to contracts for nursing facilities or accommodation facilities according to the number of nursing residents in each batch and according to current spending levels.

- In cases where people with meritorious service or relatives of martyrs are on the nursing care list that has been approved by the Department of Labor, War Invalids and Social Affairs but have not yet implemented it and have died, they will still be granted nursing benefits according to family nursing expenses for relatives.
