Procedure for the Issuance of Professional Certificates for Conservation, Restoration, and Rehabilitation of Historical Monuments
Legal Basis:
- Decree 61/2016/ND-CP;
- Decree 142/2018/ND-CP;
- Circular 15/2019/TT-BVHTTDL;
1. Conditions for Issuance:
- Certificate of practice for making relic restoration planning:
a) Established in accordance with the law;
b) Qualified to practice construction planning design according to construction law;
c) Having at least one individual granted a Certificate of practice for making relic restoration planning.
- Certificate of practice for making relic restoration project, economic-technical report on relic restoration, relic restoration design:
a) Established in accordance with the law;
b) Qualified to practice construction design according to construction law;
c) Having at least one individual granted a Certificate of practice for making relic restoration projects, economic-technical reports on relic restoration, relic restoration designs.
- Certificate of practice for relic restoration construction:
a) Established in accordance with the law;
b) Qualified in construction execution as per construction law;
c) Having at least one individual granted a Certificate of practice for relic restoration construction.
- Certificate of practice for supervising relic restoration construction:
a) Established in accordance with the law;
b) Qualified in consultancy for supervising construction execution as per construction law;
c) Having at least one individual granted a Certificate of practice for supervising relic restoration construction.
2. Application Dossier includes 01 set:
Individuals submit directly or send via postal service 01 set of dossier to the competent authority stipulated in Article 10 of Decree 61/2016/ND-CP. The dossier includes:
- Application form according to Form No. 05 in the Appendix issued with Decree 61/2016/ND-CP;
- Copy of the Certificate of practice for construction planning design, construction design, supervision of construction execution, university degree or higher in construction, architecture related to the activity for which the Certificate of practice issuance is applied as per point a clause 1, point a clause 2, point a clause 3 and point a clause 4 Article 9 of Decree 61/2016/ND-CP;
- Copy of the certificate or confirmation of having participated in the relic restoration knowledge enhancement program;
- 02 color photos sized 3x4 cm taken in the year applying for issuance.
3. Implementation Sequence:
- The organization applying for the Certificate of practice submits directly or sends via postal service 01 set of dossier to the Director of the Department of Culture, Sports and Tourism or the Director of the Department of Culture and Sports where the relic restoration organization is headquartered.
- Within 05 working days from the receipt of the dossier as stipulated, the Director of the Department of Culture, Sports and Tourism or the Director of the Department of Culture and Sports is responsible for checking and requesting additional documents if incomplete or invalid.
- Within 10 working days from the receipt of a complete and valid dossier, the Director of the Department of Culture, Sports and Tourism or the Director of the Department of Culture and Sports is responsible for considering and deciding to issue the Certificate of practice according to Form No. 09 in the Appendix issued with Decree 61/2016/ND-CP, simultaneously reporting to the Minister of Culture, Sports and Tourism. In case of refusal, a written response stating the reason must be provided.
4. Processing Time: 15 working days from the receipt of a complete and valid dossier.
5. Issuing Authority: Ministry of Culture, Sports and Tourism
6. Fees: According to the regulations of the Ministry of Finance.
7. Validity Period of Certificate of Practice: 05 years.
