Principle of Implementing Policies, Preferential Policies for People with Meritorious Services to the Revolution and Their Relatives as Per New Regulations
How are the principles of implementing policies, preferential policies for people with meritorious services to the revolution and their relatives defined according to the new regulations? Looking forward to your response.The principles for implementing the policies and preferences for those with meritorious services to the Revolution and their relatives are stipulated in Article 6 of the 2020 Ordinance on Preferences for Persons with Meritorious Services to the Revolution (effective from July 1, 2021). Specifically:
- Caring for the health, material, and spiritual lives of persons with meritorious services to the Revolution and their relatives is the responsibility of the State and society. The State encourages organizations and individuals to care for, assist, and implement the policies and preferences for persons with meritorious services to the Revolution.
- The preferential treatment regime for persons with meritorious services to the Revolution and their relatives must be determined and adjusted in accordance with the socio-economic conditions of the country in each period; ensuring that the living standard of persons with meritorious services to the Revolution is equal to or higher than the average level of the residential community where they reside.
- Persons with meritorious services to the Revolution falling under multiple categories shall enjoy allowances and subsidies of multiple categories; regarding caretaker allowances and preference policies stipulated in Clause 2, Article 5 of this Ordinance, only the highest level of one preferential policy will be enjoyed.
- Persons with meritorious services to the Revolution and their relatives as stipulated in Clause 12, Article 16, and Clause 1, Article 31 of this Ordinance, if deceased, the person or organization conducting the funeral shall be entitled to a funeral allowance according to the regulations of the law on social insurance; in cases where multiple categories are applicable, only one funeral allowance shall be provided.
In cases where the subjects stipulated in this clause simultaneously fall under the category eligible for funeral allowances according to the law on social insurance, they shall receive the funeral allowance as per the law on social insurance; in cases where they simultaneously qualify for funeral policies ensured by the state budget according to other legal normative documents, only one funeral policy with the highest level shall be provided.
- When a person with meritorious services to the Revolution dies and has relatives entitled to a monthly survivorship allowance according to this Ordinance, the relatives will receive a monthly survivorship allowance as follows:
+ Relatives of two or more persons with meritorious services to the Revolution are entitled to a maximum of two monthly survivorship allowances, except as stipulated in Point a, Clause 3, Article 16 of this Ordinance;
+ Relatives of one martyr who are also relatives of two or more persons with meritorious services to the Revolution are entitled to the monthly survivorship allowance of one martyr and the monthly survivorship allowance of one person with meritorious services to the Revolution;
+ Relatives of two or more martyrs who are also relatives of persons with meritorious services to the Revolution are entitled to the monthly survivorship allowance according to Point a, Clause 3, Article 16 of this Ordinance;
+ Relatives of persons with meritorious services to the Revolution, where the person with meritorious services falls into two or more categories, are entitled to the monthly survivorship allowance of one category;
+ Children of persons with meritorious services to the Revolution aged 18 and over, if they have been receiving a monthly survivorship allowance during their study at a vocational education institution, higher education institution or are currently receiving a monthly survivorship allowance during their study at a vocational education institution, higher education institution and drop out or are expelled, will no longer be entitled to the monthly survivorship allowance.
- Relatives of persons with meritorious services to the Revolution eligible for an additional monthly nurturing allowance will receive one monthly nurturing allowance.
