In Article 8 of Circular 44/2022/TT-BTC (effective from September 5, 2022), it stipulates payment of preferential regimes for people with meritorious services to the revolution through a payment service organization, as follows:

1. The selection of a service organization for payment of preferential regimes for people with meritorious services to the revolution shall comply with the provisions of law and the guidance of the Ministry of Labor, War Invalids and Social Affairs, ensuring a network of points. transactions in communes, wards and townships, can take care of paying at home for a number of specific subjects and apply modern information technology to combine payment activities with object management, ensuring ensure that the payment of the regime is correct, sufficient, timely and safe.

2. The payment through a payment service organization is made under a contract between the Labor - Invalids and Social Affairs agency (the Department of Labor - Invalids and Social Affairs or the Department of Labor - Invalids and Social Affairs depending on the according to the decentralization of each locality) or an agency assigned by a competent authority to manage and use funds for the implementation of the preferential regime for people with meritorious services to the revolution and payment service organization, clearly stating the scope of payers, payment methods (including direct payment in cash, payment through the banking system and non-cash methods as prescribed by law), money transfer method and time of payment for remittance, time limit for payment to beneficiaries, level of payment expenses, time limit for payment and settlement, rights and responsibilities of the parties, other agreements related to the payment.

3. Before the 25th of every month, the Department of Labor, War Invalids and Social Affairs shall base itself on the list of beneficiaries (including beneficiaries of an increase or decrease in monthly allowances, and one-time allowance beneficiaries); the next month's expenses (including the arrears and funeral expenses of the subject); the remaining funds that have not been paid in the previous month (if any) shall be withdrawn at the State Treasury and transferred to the deposit account of the payment service organization; at the same time, transfer the list of payments to the next month's payment service organization. During the payment period, the Labor - Invalids and Social Affairs agency is responsible for appointing a person to supervise the payment of the payment service organization.

In case the time for payment of allowances and allowances is close to the Lunar New Year or during the time of natural disasters, epidemics or due to force majeure as determined by the competent authority, the Labor - Invalids and Social Affairs agency considers and decides on the implementation of 2-month lump sum payments to beneficiaries.

4. Monthly, the payment service organization shall summarize and report the list of recipients of money and the amount paid; list of subjects who have not yet received money to transfer payments next month, the remaining amount of funds that have not been paid and transfer documents (signed list and bank transfer documents) to the Labor - Invalids and Social Affairs agency. Social before the 20th of every month. The Department of Labor, War Invalids and Social Affairs shall summarize and finalize payment expenses according to regulations.

What are regulations on estimation for the implementation of policies and incentives for people with meritorious services to the revolution in Vietnam?

According to Article 9 of Circular 44/2022/TT-BTC (effective from September 5, 2022), stipulating estimation for the implementation of policies and incentives for people with meritorious services to the revolution, the regulations are as follows:

1. The cost estimates for implementation of preferential policies for people with meritorious services to the revolution shall be detailed according to each type of monthly allowance, one-time allowance, expenditure for implementation of regimes, policies and management expenses according to regulations. prescribed in Decree No. 75/2021/ND-CP, Decree amending and supplementing (if any) of the Government, Clause 4, Article 5 and Article 7 of this Circular.

2. The annual budget estimates shall be made according to the provisions of the State Budget Law and its guiding documents. In addition, this Circular specifically guides the process and time sequence for making the estimate as follows:

a) Agencies assigned to manage and use funds for people with meritorious services to the revolution and establishments for nurturing, nursing and welcoming people with meritorious services to the revolution shall make estimates of the plan year and send them to the Department of Labor and War Invalids. and Society before June 20 of each year;

b) The Department of Labor, War Invalids and Social Affairs shall make estimates of expenditures at the Department of Labor, War Invalids and Social Affairs to implement, consider the estimates of the management agencies and use the funds of people with meritorious services to the revolution. and establishments for nurturing, nursing and welcoming people with meritorious services to the revolution; synthesize estimates of the whole province and city and send it to the Ministry of Labor - Invalids and Social Affairs before July 5 every year;

c) The Ministry of Labor - Invalids and Social Affairs considers the estimates of the Departments of Labor - Invalids and Social Affairs; sum up the country's estimate and send it to the Ministry of Finance before July 20 every year;

d) The Ministry of Finance considers and compiles the cost estimates of incentives for people with meritorious services to the revolution into the state budget expenditure estimates, submits them to competent authorities for approval and assigns the estimates to the Ministry of Labor - Invalids and Social Affairs in accordance with the law on state budget.

3. For the estimate of funding to support the work of martyrs' graves, works for martyrs' attribution and support for material foundations in service of nurturing, nursing and welcoming people with meritorious services to the revolution:

a) Support to build new martyrs' graves including stele inscribed with the names of martyrs (not associated with the project of building and upgrading cemetery); support to renovate, upgrade and repair martyrs' graves, including stele inscriptions of martyrs' names: Estimated number of newly built martyrs' graves, number of graves renovating, repairing, maintaining, and funding according to support norms specified in Clause 1, Article 11 of Decree No. 75/2021/ND-CP ;

b) Support to renovate, upgrade, repair and maintain works of martyrs, facilities in service of nurturing, nursing and welcoming people with meritorious services to the revolution: Name of necessary works or equipment renovating, upgrading, repairing and maintaining; reasons and objectives of renovation, upgrading, repair and maintenance; expected workload; Expected funding; estimated implementation time, completion time and implementation budget according to the support norms specified in Clauses 2 and 3, Article 11 and Point a, Clause 10, Article 13 of Decree No. 75/2021/ND-CP;

c) Support in procurement of equipment, means, tools and instruments of nursing and nurturing establishments for people with meritorious services to the revolution: Estimated number of subjects, nursing beds, nursing facilities and experience Fees shall comply with support norms specified at Point b, Clause 10, Article 13 of Decree No. 75/2021/ND-CP.
