How many days off are there for employees in Vietnam during New Year 2025?
Pursuant to Article 112 of the Labor Code 2019 stipulating public holidays:
Article 112. Public Holidays
- Employees are entitled to days off work and fully paid on the following public holidays:
a) New Year: 01 day (January 1);
b) Lunar New Year: 05 days;
c) Victory Day: 01 day (April 30);
d) International Labor Day: 01 day (May 1);
dd) National Day: 02 days (September 2 and 01 consecutive day immediately before or after);
e) The Hùng Kings' Commemoration Day: 01 day (March 10 of the lunar calendar).
- Foreign employees working in Vietnam, in addition to the days off as prescribed in Clause 1 of this Article, are entitled to one additional traditional Tet holiday and one additional National Day of their country.
- Annually, based on actual conditions, the Prime Minister of the Government of Vietnam decides the specific day off prescribed at Points b and đ, Clause 1 of this Article.
According to the above regulations, employees are entitled to one day off for the New Year (January 1). In 2025, New Year falls on Wednesday (January 1, 2025), a weekday, so officials, public employees, and employees will have the day off on Wednesday, January 1, 2025.
If the employer stipulates a weekly day off on Wednesday, employees will be arranged to have a compensatory day off on another day. (Clause 3, Article 111 of the Labor Code 2019)
When can employers require employees to work overtime on New Year 2025 in Vietnam?
Pursuant to Article 107 of the Labor Code 2019 regarding overtime:
Article 107. Overtime
- Overtime is the time worked outside of normal working hours as prescribed by law, collective labor agreement, or internal labor regulations.
- Employers may require employees to work overtime when fully meeting the following requirements:
a) It must be agreed upon by the employee;
b) Ensure that the employee's overtime does not exceed 50% of the normal working hours in one day; in case of applying normal working hours according to the week, the total working hours including overtime shall not exceed 12 hours in one day; and not more than 40 hours in one month;
c) Ensure that the employee's overtime does not exceed 200 hours in one year, except for the cases specified in Clause 3 of this Article.

According to the above regulations, employers may require employees to work overtime if they have the employee's consent. Therefore, employers are not allowed to mandate overtime on New Year 2025, except in the following cases:
- Implementing mobilization orders and ensuring national defense and security tasks according to the law.
- Conducting work to protect human lives, property of agencies, organizations, or individuals in preventing, overcoming the consequences of natural disasters, fire, dangerous epidemics, and catastrophes, except in cases where there is a risk affecting employees' lives and health according to the laws on occupational safety and hygiene.
