Management Measures for Drug Addicts during Procedures for Admission to Rehabilitation Centers
Forms of management for drug addicts during the process of placing them into rehabilitation facilities
Based on Article 45 of Decree 116/2021/ND-CP, the forms of management for drug addicts during the process of placing them into rehabilitation facilities are as follows:
Family Management: This is applied to drug addicts who have a stable residence, and whose families (father, mother, wife or husband, siblings aged 18 and older) agree to manage them. The family representative must confirm in writing according to Form No. 35, Appendix II of this Decree.
Management at rehabilitation facilities or centers for receiving social subjects (hereinafter referred to as management facilities): This is applied to drug addicts who do not have a stable residence, or who have a stable residence but whose families (father, mother, wife or husband, siblings aged 18 and older) do not agree to manage them. The family representative must confirm in writing according to Form No. 35, Appendix II of this Decree.
Subjects of management for drug addicts during the process of placing them into rehabilitation facilities
Based on Article 44 of the above Decree, the subjects of management for drug addicts during the process of placing them into rehabilitation facilities are as follows:
Drug addicts who are in the process of being placed into compulsory rehabilitation facilities must be managed by one of the two forms specified in Article 45 of this Decree.
The management period is calculated from the time the dossier is compiled until the time the competent authority places the subject into a compulsory rehabilitation facility according to the court's decision.
The management period at rehabilitation facilities or centers for receiving social subjects for the subjects specified in Clause 1 of this Article shall be deducted from the compulsory rehabilitation period.
