Issuance of Excerpts from Records of Persons with Merit, Copies of Records of Persons with Merit in Which Cases?
Pursuant to Clause 1, Article 129 of Decree 131/2021/ND-CP (Effective from February 15, 2022) regulating the issuance of excerpts from records of persons with merit, copies of the records of persons with merit in the following cases:
- Issuance of excerpts from the records of persons with merit or copies of certain documents within the records of persons with merit at the request of persons with merit or their relatives to resolve policies related to the requested content.
Relatives receiving monthly death benefits who change their place of permanent residence but still have other relatives receiving monthly death benefits at the old place, the Department of Labor, War Invalids, and Social Affairs will issue an excerpt from the records of persons with merit along with a certified true copy of the decision on the monthly death benefit to the new place of permanent residence.
- Issuance of excerpts or copies of the records of persons with merit at the request of an agency or organization to resolve related matters.
In cases where the records of war invalids and martyrs are recognized on or before December 31, 1994, but are incomplete according to regulations (due to loss), the Department of Labor, War Invalids, and Social Affairs will issue an official dispatch requesting an excerpt from the records to the Policy Department, General Political Department of the Vietnam People's Army, or the Personnel Department, Ministry of Public Security (for excerpts from invalids' records); or the Department of Persons with Meritorious Services, Ministry of Labor, War Invalids, and Social Affairs (for excerpts from martyrs' records) as a basis for resolving policies.
Dossiers and Procedures for Issuance of Excerpts from Records of Persons with Merit, Copies of Records of Persons with Merit
Clause 3 of this Article stipulates the dossiers and procedures for issuance of excerpts from records of persons with merit, copies of records of persons with merit as follows:
- Individuals shall submit an application clearly stating the reasons for requesting an excerpt or copies of certain documents within the records of persons with merit to: the Policy Department, General Political Department; or the Personnel Department, Ministry of Public Security for those currently in service, working, or invalids not yet receiving preferential policies due to sending their books to B; or the Department of Labor, War Invalids, and Social Affairs for other cases.
- Agencies or organizations shall submit a document clearly stating the reasons for requesting an excerpt, copies of certain documents, or the entire records of persons with merit, to the agencies or units specified at point a of this clause.
- Agencies or units specified at point a of this clause within 12 days from the date of receipt of the application or document, are responsible for checking and comparing the reason according to regulations to issue excerpts from records, copies of certain documents, or the entire records to the requested place; preparing a monitoring form according to Form No. 92 Appendix I of this Decree.
