Is it illegal to sell alcohol near schools in Vietnam?
I want to open a pub near the school, is it possible? If I open a pub, will there be any penalty in Vietnam? Please advice.
Can alcohol be sold near schools in Vietnam?
Pursuant to Clause 7, Article 32 of the Law on Prevention and Control of harmful effects of alcohol, beer 2019 has the following provisions:
7. From the effective date of this Law, it is not allowed to open new on-premise establishments within 100 m from health facilities, nurseries, infant schools, kindergartens and general education schools.
According to this Article, from June 14, 2019, all alcohol and beer selling points for on-site consumption must be opened within 100 meters of kindergartens, kindergartens, preschools, and general education schools in Vietnam. So you do not open pubs near schools like above.
Is it illegal to sell alcohol near schools in Vietnam?
Pursuant to Article 31 of Decree 117/2020/ND-CP has the following provisions:
1. A fine ranging from VND 1.000.000 to VND 3.000.000 shall be imposed for commission of one of the following violations:
a) Selling or supplying alcoholic beverages to persons aged under 18;
b) Failing to post a notice stating that “It’s is illegal to sell alcoholic beverages to anyone under the age of 18” at a prominent place in the establishment that sells alcoholic beverages.
2. A fine ranging from VND 5.000.000 to VND 10.000.000 shall be imposed for commission of one of the following violations:
a) Selling alcoholic beverages at places where the sale of alcoholic beverage is not allowed;
b) Establishing a new on-premise establishment within a radius of 100 m from the outer boundary of a health facility, kindergarten, nursery school, pre-school or general education school.
3. A fine ranging from VND 10.000.000 to VND 20.000.000 shall be imposed for failing to satisfy one of the eligibility requirements when selling alcoholic beverages through e-commerce.
4. Additional penalty:
The license to trade alcoholic beverages shall be suspended for a fixed period of 01 - 03 months in case of commission of the violation in Point b Clause 2 or Clause 3 of this Article.
According to this Article, if you sell pubs within a radius of 100 m from the premises of a kindergarten, kindergarten, preschool, or general education institution, you may be subject to a fine of from 10,000,000 VND. up to 20,000,000 VND in Vietnam.
