Is a person who rendered meritorious services to the revolution entitled to preferential allowance upon death?
According to Article 38 of the 2020 Ordinance on Preferential Treatment for People with Meritorious Services to the Revolution, regulations on conditions and standards for people who have helped the revolution state:
Persons with meritorious services to the revolution are those who have a record of assisting the revolution during difficult and dangerous times and have been commended by the State in one of the following cases:
Persons who have been awarded, or whose family members have been awarded, the "Fatherland Acknowledges Merit" Commemorative Medal or the "Meritorious Service to the Nation" Certificate before the August Revolution of 1945;
Persons who have been awarded, or whose family members have been awarded, the Resistance Medal;
Persons who have been awarded, or whose family members have been awarded, the Resistance Badge.
Thus, in the case of your father, who is recognized as a person with meritorious services to the revolution and has been awarded the Resistance Medal by the State, he shall be entitled to the following policies:
- One-time allowance;
- Health insurance;
- Housing improvement support based on individual merit and circumstances or in case of housing difficulties;
- Exemption or reduction of land levy when allocated homestead land by the State, conversion of land use to homestead land, recognition of the right to use homestead land, or purchasing housing owned by the State;
According to the information you provided, your father has passed away but had not received any allowance previously. Therefore, based on Clause 4 Article 4 of Decree 75/2021/ND-CP, the family may be entitled to a one-time preferential allowance amounting to VND 2,436,000 (equivalent to 1.5 times the current standard rate, which is VND 1,624,000).
