If my wife is a teacher and has been disciplined, is my family eligible to get the title of Family of Culture in Vietnam?

Pursuant to Article 6 of Decree 122/2018/ND-CP stipulating standards for the title of Family of Culture as follows:

1. Exemplary compliance with the Party's guidelines and policies; State law; Actively participate in emulation movements of the locality where you reside, including the following criteria:

a) Family members comply with the provisions of law; not be disciplined at work and study;

b) Comply with local conventions and regulations of the community where you reside;

c) Hang the National Flag during holidays and political events of the country according to regulations;

d) Participate in one of the cultural or artistic activities at your place of residence; regularly practice exercise and sports;

d) Implement a civilized lifestyle in weddings, funerals and festivals according to regulations;

e) Participate in protecting historical-cultural relics, scenic spots, and local natural landscapes;

g) Implement regulations on environmental sanitation, dump trash and waste on time and in the right place;

h) Fully participate in charity, humanitarian movements, gratitude, and promotion of learning and talent; Community activities at residence;

i) Do not violate regulations on food hygiene and safety and disease prevention;

k) Do not violate regulations on fire and explosion prevention and fighting;

l) Do not violate the law on traffic order and safety such as: Encroaching on roads, sidewalks, participating in traffic not according to regulations.

2. Family harmony, happiness, progress; Support and help people in the community, including the following criteria:

a) Grandfathers, grandmothers, fathers, mothers and other family members are cared for, cared for and cared for;

b) Voluntary, progressive, monogamous marriage, equality, harmony, and fidelity;

c) Implement population policy well; implement gender equality;

d) Family members participate in health insurance and receive health care;

d) Family members have a healthy, civilized lifestyle and behave culturally in the family, community and society;

e) Support and help people in the community in times of difficulty and distress.

3. Organize labor, production, business, work and study to achieve productivity, quality and efficiency, including the following criteria:

a) The family economy is stable and develops from a legitimate source of income;

b) Participate in economic, cultural and social development programs and plans organized by the locality;

c) People of working age actively work and have a legitimate income;

d) Children of school age can go to school;

d) Use clean water;

e) Have sanitary facilities;

g) Have audio and visual means and regularly access economic, cultural and social information.

Thus, to be considered for the title of Family of Culture, your family must meet the conditions and standards specified above. One of the standards is that family members comply with the provisions of the law in Vietnam; Not subject to disciplinary action at work or study.

Therefore, if your wife is a teacher and is given a disciplinary warning at work, your family does not meet the conditions and standards to consider this title in Vietnam.

What violations will family members commit that not be considered for the title of Family of Culture in Vietnam? 

According to Article 7 of Decree 122/2018/ND-CP, the following cases are not considered for awarding the title of Family of Culture:

A family member violates one of the following cases:

1. Be prosecuted for criminal liability or subject to administrative measures according to the provisions of the Law on Handling of Administrative Violations.

2. Failure to complete military service and tax payment obligations.

3. Be sanctioned for administrative violations in the field of construction; fire prevention, fire fighting and environmental protection.

4. There is a child marriage or a consanguineous marriage.

5. Domestic violence is subject to administrative sanctions.

6. Suffer from social evils, drugs, prostitution, theft, organizing gambling or gambling.

7. Participate in large gatherings causing loss of social order and safety.
c) Implement population policy well; implement gender equality;

d) Family members participate in health insurance and receive health care;

According to this Article, if a family member violates one of the cases specified above, the family will not be considered for the title of Family of Culture in Vietnam.
