If my grandfather, who was active in the resistance war, was infected with a toxic chemical and died, will his grandchild receive a survivorship benefit in Vietnam?

If my grandfather, who was active in the resistance war, was infected with a toxic chemical and died, will his grandchild receive a survivorship benefit in Vietnam? What incentives are available to resistance activists infected with toxic chemicals in Vietnam?

Hello, I have this problem that needs to be answered. My grandfather was a resistance activist but was infected with toxic chemicals and had a 40% injury rate. He just passed away on July 31. Let me ask, if my grandfather was active in the resistance and was contaminated with toxic chemicals, will his grandchild be entitled to survivorship benefits?

Please advise. Thankyou.

If my grandfather, who was active in the resistance war, was infected with a toxic chemical and died, will his grandchild receive a survivorship benefit in Vietnam?

In Clause 3, Article 31 of the Ordinance on preferential treatment for people with meritorious services to the Revolution, it is stipulated that if resistance activists are infected with toxic chemicals and have a bodily injury rate of 61% or more and die, their relatives will be entitled to survivorship benefits as follows:

a) Biological father, biological mother, spouse of full age as prescribed in Clause 2, Article 169 of the Labor Code, children under 18 years old or 18 years old or older if still attending school or severely disabled, especially severe disabilities are entitled to monthly survivorship benefits;

b) The biological father or mother lives alone, the spouse is of full age as prescribed in Clause 2, Article 169 of the Labor Code lives alone, the child is an orphan with both parents under 18 years old or at least 18 years old If you continue to go to school or have a severe or especially severe disability, you will receive a monthly survivorship benefit and a monthly maintenance allowance.

Thus, you are not eligible for survivorship benefits when your grandfather passes away because:

First: He has a bodily injury rate of 40%, but the law stipulates that resistance activists must be a participant in resistance activities exposed to toxic chemicals with a bodily injury rate of 61% or higher.

Second: Subjects who receive survivorship benefits are only their biological father, biological mother, spouse, and children under 18 years old or 18 years old or older if they continue to study or have a disability. If you are a grandchild, you are not one of those subjects.

2. Monthly allowance for resistance activists infected with toxic chemicals with a bodily injury rate of 81% or more.

3. Service allowance for resistance activists infected with toxic chemicals and with a bodily injury rate of 81% or more living at home.
