If both parents are lost due to flood, will the child receive state support?
Both parents were swept away by the flood; will the child be supported by the state?
According to Clause 1, Article 16 of Decree 20/2021/ND-CP providing for emergency assistance for children when their parents are dead or missing due to natural disasters, fires, epidemics, or other force majeure reasons, as follows:
- Children whose both parents are dead or missing due to natural disasters, fires, epidemics, or other force majeure reasons, and have no relatives to care for and nurture them, will be supported under the provisions of Clause 2, Article 19 of this Decree.
According to Clause 2, Article 19 of Decree 20/2021/ND-CP:
- Subjects specified in Clause 2, Article 18 of this Decree, when living in a household receiving care and nurturing, shall be supported as follows:
a) Food expenses during the period of living in a household receiving care and nurturing;
b) Treatment costs in case of treatment at medical examination and treatment facilities without health insurance;
c) Costs of transporting the subject to their place of residence or to a social assistance facility, social house.
Therefore, in the case of both parents being swept away by the flood, the child will be supported by the state as prescribed above.
Do orphans of both parents receive care and nurturing in the community?
According to Clause 1, Article 18 of Decree 20/2021/ND-CP, the subjects receiving care and nurturing in the community are specified as follows:
- Subjects eligible to be cared for and nurtured monthly by households and individuals in the community include:
a) Subjects specified in Clause 1, Article 5 of this Decree;
b) Subjects specified at Point d, Clause 5, Article 5 of this Decree;
c) Subjects specified in Clause 6, Article 5 of this Decree.
According to Clause 1, Article 5 of Decree 20/2021/ND-CP:
- Children under 16 years old without sources of support in one of the following cases:
a) Abandoned and not yet adopted;
b) Orphans of both parents;
c) Orphans of father or mother, and the other is declared missing in accordance with the law;
d) Orphans of father or mother, and the other is benefiting from care and nurturing policies at social assistance facilities, social house;
...
Orphans of both parents can be cared for and nurtured in the community.
