When does the 2024 Lunar New Year holiday in Vietnam start?

According to the Annoucement 5015/TB-LDTBXH in 2023 on lunar new year and national day holidays in 2024 of officials, public employees and employees, the 2024 Lunar New Year holiday in Vietnam is as follows:

1. Officials, public employees and employees working at administrative agencies, political organizations or socio-political organizations (hereinafter referred to as “officials and public employees”) are entitled to have the Lunar New Year holiday in 2024 from Thursday, February 08, 2024 of the solar calendar (i.e. December 29, 2023 of the lunar calendar) to the end of Wednesday, February 14, 2024 of the solar calendar (i.e. January 05, 2024 of the lunar calendar). This holiday includes 05 days of the Lunar New Year holiday and 02 days of compensatory time-off for the weekly days off as prescribed in Clause 3 Article 111 of the Labor Code.

2. Officials and public employees are entitled to have the National Day holiday in 2024 from August 31, 2024 (Saturday) to the end of September 03, 2024 (Tuesday) of the solar calendar. This holiday includes 02 days of the National Day holiday and 02 weekly days off.

3. Any agency or unit that adopts the abovementioned holiday schedule for Lunar New Year and National Day in 2024 shall be responsible for properly assigning its personnel to ensure uninterrupted and effective operation with a view to serving organizations and individuals.

4. Any agency or unit that does not take automatic days-off on Saturday and Sunday every week shall, depending on its specific work program or plan, set an appropriate holiday schedule of their own.

5. With regard to employees other than those prescribed in Clause 1 of this Announcement, employers may adopt the following holiday schedule for Lunar New Year and National Day in 2024:

- The Lunar New Year holiday may include 01 ending day of the year 2023 and 04 beginning days of the year 2024 of the lunar calendar, or 02 ending days of the year 2023 and 03 beginning days of the year 2024 of the lunar calendar, or 03 ending days of the year 2023 and 02 beginning days of the year 2024 of the lunar calendar.

As regulations above, the 2024 Lunar New Year holiday of officials, public employees and employees will start as following schedule:

[1] Officials, public employees and employees are entitled to have the Lunar New Year holiday in 2024 from Thursday, February 08, 2024 of the solar calendar (i.e. December 29, 2023 of the lunar calendar).

[2] Employees are entitled to have the holiday according employers' decision and in following 2 methods:

- The Lunar New Year holiday may include 01 ending day of the year 2023 and 04 beginning days of the year 2024 of the lunar calendar, or 02 ending days of the year 2023 and 03 beginning days of the year 2024 of the lunar calendar

- The Lunar New Year holiday may include 03 ending days of the year 2023 and 02 beginning days of the year 2024 of the lunar calendar.

Therefore, the time for holiday for the 2024 Lunar New Year depends on the official announcement of the employer. The announcement of the 2024 Lunar New Year holiday will be announced to employees one month in advance.

Can employees in Vietnam receive salary advance before the Lunar New Year holiday?

Pursuant to Article 101 of the Cilvil Code in 2019 stipulating salary advances as follows:

Salary advances

1. An employee may receive an interest-free salary advance in accordance with conditions agreed on by the two parties.

2. The employer must make the advance payment to the employee for the number of days the employee temporarily leaves his/her work in order to perform duties of citizens for a period of 01 week or longer, but the advance shall not exceed 01 month’s salary. The employee must reimburse the advance.

An employee who is conscripted in accordance with the Law on Conscription may not receive salary advance.

3. When taking annual leave, an employee shall receive an advance payment of at least salary for the entitled days of leave.

As regulations above, employees can negotiate with their employers about the advance payment of salary before the 2024 Lunar New Year holiday. The employer must give the employee an advance payment of salary and not charge interest on this amount.
