How many days off will employees in Vietnam have for the National Day holiday on September 2nd, 2024?

(1) Regarding officials, public employees and employees working at state agencies:

According to Official Dispatch 8662/VPCP-KGVX in 2023 on the Lunar New Year Holiday and National Day Holiday Schedules in 2024 issued by the Government Office of Vietnam, the Schedule for the National Day holiday is as follows:

In consideration of the request of the Ministry of Labor - War Invalids and Social Affairs in Document No. 4594/LDTBXH-ATLD dated October 27, 2023 proposing the Lunar New Year Holiday and National Day Holiday Schedules in 2024, Prime Minister of Vietnam Pham Minh Chinh hereby:

1. Agrees with the proposal of the Ministry of Labor - War Invalids and Social Affairs of Vietnam in the mentioned document for the schedules for the Lunar New Year Holiday (from February 8, 2024 to February 14, 2024) and the National Day Holiday (from August 31, 2024 to September 3, 2024).

2. Assigns the Minister of Labor – War Invalids and Social Affairs of Vietnam to inform administrative agencies, public service providers, political organizations, socio-political organizations, enterprises, and employees of the Lunar New Year Holiday and National Day Holiday Schedules in 2024.

According to the announcement from the Ministry of Labor – War Invalids and Social Affairs, officials, public employees, and employees working in state agencies will have days off for the National Day holiday in 2024 from August 31, 2024 to September 3, 2024.

The National Day holiday period in 2024 for officials, public employees, and employees working in state agencies will last for 4 days, including 2 National Day holidays and 2 regular weekly days off.

(2) For employers in the private sector, they can proactively choose the option of granting days off for the National Day holiday.

For employees who are not part of administrative agencies, professional careers, political organizations, or socio-political organizations, the employers have the discretion to choose the option of granting days off for the National Day holiday in 2024.

During the National Day holiday, the employers can choose one of the two days: Sunday, September 1st or Tuesday, September 3rd.

The employers must notify the employees of their chosen option for the National Day holiday in 2024 at least 30 days before its implementation.

If the regular weekly day off coincides with a public holiday, the employees are entitled to make up for the missed day off on the following working day.

The schedule for the National Day holiday on September 2nd, 2024 for employees in the private sector may be as follows:

- Businesses that have their regular weekly day off on Saturday and Sunday will have 4 days off. They will have a day off on September 2nd, and an additional day off before or after September 2nd, along with their two regular weekly days off (or one regular weekly day off and one make-up day off as stipulated in Clause 3, Article 111 of the Labor Code in 2019).

Therefore, employees will have days off starting from August 31, 2024 to September 3, 2024.

Businesses that have their regular weekly day off on Sunday will have 3 days off. They will have a day off on September 2nd, and an additional day off before or after September 2nd, along with their regular weekly day off (or one regular weekly day off and one make-up day off as stipulated in Clause 3, Article 111 of the Labor Code in 2019).

Therefore, employees will have days off starting from September 1, 2024 to September 3, 2024.

What are regulations on the salary of employees who work overtime on the public holidays in Vietnam?

Pursuant to Article 98 of the Labor Code in 2019:

Overtime pay, night work pay

1. An employee who works overtime will be paid an amount based on the piece rate or actual salary as follows:

a) On normal days: at least 150%;

b) On weekly days off: at least 200%;

c) During public holidays, paid leave, at least 300%, not including the daily salary during the public holidays or paid leave for employees receiving daily salaries.

2. An employee who works at night will be paid an additional amount of at least 30% of the normal salary.

3. An employee who works overtime at night will be paid, in addition to the salary specified in Clause 1 and Clause 2 of this Article, an amount of at least 20% of the day work salary of a normal day, weekend or public holiday.

4. The Government shall elaborate this Article.

As regulated above, employees who work overtime on the public holidays in Vietnam shall receive an amount of 300% based on the piece rate or actual salary, not including the daily salary during the public holidays or paid leave for employees receiving daily salaries.

In addition, if they work at night, they will be paid an additional amount of at least 30% of the normal salary.

An employee who works overtime at night will be paid an amount of at least 20% of the day work salary of a normal day, weekend or public holiday.

What are methods of salary payment in Vietnam?

Pursuant to Article 96 of the Labor Code in 2019:

Salary payment forms

1. The employer and employee shall reach an agreement on whether the salary is time-based, product-based (piece rate) or a fixed amount.

2. Salary shall be paid in cash or transferred to the employee’s personal bank account.

In case of bank transfer, the employer shall pay the costs of account opening and transfer.

3. The Government shall elaborate this Article.

As regulated above, the employer shall pay the employee on the basis of the agreed method of salary payment.
