Giving Birth to Twins in the Second Birth: Is it Considered a Violation of the Population Policy?
Legal Basis: Decree 20/2010/ND-CP; Decree 18/2011/ND-CP
Cases that do not violate the regulations on having one or two children:
A couple having a third child if both or one of them belongs to an ethnic group with a population of less than 10,000 people or an ethnic group at risk of population decline (birth rate less than or equal to death rate) according to the official announcement by the Ministry of Planning and Investment.
A couple having their first children where they have triplets or more.
A couple having one biological child, giving birth to twins or more the second time.
A couple having a third child or more if at the time of birth, there is only one living biological child, including a biological child who has been adopted.
A couple having a third child if they already have two biological children, of which one or both are disabled or suffer from non-hereditary severe diseases confirmed by the provincial or central health assessment council.
Couples with separate children (biological):
a) Have one or two children if one of the partners has separate children (biological);
b) Have one child or twins or more in one birth if both partners have separate children (biological). This rule does not apply if both partners have already had two or more common children who are still alive.
- Unmarried women giving birth to one or two children or more in one birth.
Additionally, you are allowed to have a third child if both or one of you belongs to an ethnic group with a population of less than 10,000 people or an ethnic group at risk of population decline (a rate less than or equal to the death rate) according to the official announcement by the Ministry of Planning and Investment.
=> Thus, in your case, since your husband has one separate child, both of you are allowed to have one or two more children. Therefore, if in the first birth, you have twins, you are not permitted to have more, but since this is the second birth and you only have one common child, you can certainly have more children. Even if the pregnancy is twins, it will not be considered a violation of population policy.
