Entitled to Survivorship Benefits, Can One Receive Elderly Allowance?
Pursuant to Article 2 of the Law on Elderly People 2009, Vietnamese citizens aged 60 and above fall under the category of elderly people as defined in the Law on Elderly People.
Pursuant to Point a Clause 5 Article 5 of Decree 136/2013/ND-CP which stipulates the subjects eligible for monthly social allowance, including individuals aged 80 and above who do not receive a pension, monthly social insurance allowance, or monthly social allowance, will be entitled to social allowance as elderly people.
Since you did not provide sufficient information, we cannot conclude whether your mother is eligible for elderly social allowance.
If your mother has received a lump-sum survivorship allowance and has no other income, she will be entitled to receive a monthly social allowance as an elderly person.
However, if your mother is receiving a monthly survivorship allowance, she will not be entitled to the monthly social allowance as an elderly person.
