Dossier and Procedures for Recognition of Revolutionary Participants from January 1, 1945 to the August Revolution of 1945

Based on Article 12 of Decree 131/2021/ND-CP (Effective from February 15, 2022), provisions on the dossier and procedures for recognition of revolutionary participants from January 1, 1945 to the August Revolution of 1945 are as follows:

- Individuals must write a declaration according to Form No. 02, Appendix I of this Decree, and send it to the commune-level People's Committee of their usual residence, along with one of the documents stipulated in Article 10 of this Decree.

- The commune-level People’s Committee, within 5 working days from the day of receiving all documents specified in Clause 1 of this Article, has the responsibility to confirm the declaration and send all documents to the competent authority prescribed in Article 11 of this Decree.

- The competent authority, within 20 days from the day of receiving all documents, has the responsibility to review and issue a recognition decision according to Form No. 49, Appendix I of this Decree, and transfer the dossier to the Department of Labor, War Invalids, and Social Affairs of the province where the recipient of the allowance resides to handle preferential policies.

- The Department of Labor, War Invalids, and Social Affairs, within 12 days from the day of receiving the complete dossier as stipulated, has the responsibility to issue a decision to grant a certificate for revolutionary participants from January 1, 1945 to the August Revolution of 1945, along with allowances and preferential subsidies according to Form No. 50, Appendix I of this Decree; simultaneously, issue the certificate as per Form No. 102, Appendix I of this Decree.

- The Ministry of National Defense and the Ministry of Public Security shall guide the procedures for recognizing revolutionary participants in the military and police forces from January 1, 1945 to before the August Revolution of 1945.

Timing of Benefits for Revolutionary Participants from January 1, 1945 to the August Revolution of 1945

According to Article 13 of Decree 131/2021/ND-CP (Effective from February 15, 2022), regulations on the timing of benefits for revolutionary participants from January 1, 1945 to the August Revolution of 1945 are as follows:

- Revolutionary participants from January 1, 1945 to the August Revolution of 1945 who are still alive are entitled to monthly allowances from the month the recognition decision is issued.

- Revolutionary participants from January 1, 1945 to the August Revolution of 1945 who have passed away without having received preferential policies shall have their representatives or caretakers entitled to a one-time allowance from the month the preferential allowance decision is issued.
