Determination of 42% Work Capacity Reduction as Severe Disability
Based on Clause 3, Article 4 of Decree 28/2012/ND-CP, it is stipulated as follows:
Persons with disabilities who have received a conclusion from the Medical Examination Council regarding their ability to self-serve and the degree of reduced labor capacity before the effective date of this Decree, the Council determines the degree of disability based on the conclusion of the Medical Examination Council to determine the degree of disability as follows:
a) Persons with severe disabilities when concluded by the Medical Examination Council that they no longer have the ability to self-serve or have a reduced labor capacity of 81% or more;
b) Persons with significant disabilities when concluded by the Medical Examination Council that they have the ability to self-serve in daily activities if partially assisted by a person or means, or have a reduced labor capacity from 61% to 80%;
c) Persons with mild disabilities when concluded by the Medical Examination Council that they have the ability to self-serve in daily activities or have a reduced labor capacity below 61%.
According to the provided information: if you have a certificate confirming a 42% reduction in labor capacity, you are classified as a person with mild disabilities.
