Conditions for Issuing a License for Voluntary Drug Rehabilitation Activities

What are the conditions for issuing a license for voluntary drug rehabilitation activities? Who has the authority to issue, reissue, and revoke a license for voluntary drug rehabilitation activities?

Conditions for Issuing a License for Voluntary Drug Rehabilitation Activities

Based on Article 9 of Decree 116/2021/ND-CP, the conditions for issuing a license for voluntary drug rehabilitation activities are prescribed as follows:

A facility shall be issued a license to operate voluntary drug rehabilitation activities (hereinafter referred to as the rehabilitation facility) when the following conditions are met:

  1. Established, organized, and operated in accordance with legal regulations.

  2. Possesses physical facilities that meet the requirements for drug rehabilitation activities as specified in Clauses 1, 2, 4 of Article 6 of this Decree and point e, Clause 3 of Article 36 of the Law on Drug Prevention and Control. In cases where the physical facilities are leased, the lease period must be at least 02 years from the time of submitting the application for the operation license.

  3. Has the minimum equipment and means as listed in Appendix I attached to this Decree.

  4. Personnel working at the rehabilitation facility must meet the conditions and standards as prescribed in Clause 1, Article 8 of this Decree. The head or legal representative of the rehabilitation facility must have a university degree or higher, with training or experience in drug treatment and rehabilitation, or have been involved in drug rehabilitation and treatment activities at a rehabilitation facility for 02 years or more.

  5. Has a financial plan to ensure the maintenance of the drug rehabilitation activities of the rehabilitation facility.

Authority for Issuing, Reissuing, and Revoking Licenses for Voluntary Drug Rehabilitation Activities

Based on Article 10 of the above-mentioned Decree, the authority for issuing, reissuing, and revoking licenses for voluntary drug rehabilitation activities is prescribed as follows:

The Director of the Department of Labor, War Invalids, and Social Affairs shall issue, reissue, and revoke licenses for the operation of voluntary drug rehabilitation facilities within their jurisdiction.
