What are conditions and standards for recognizing martyrs in Vietnam?
Pursuant to Article 14 of Decree 131/2021/ND-CP (Effective from February 15, 2022) stipulates conditions and standards to be recognized as martyrs as follows:
- Direct combat service specified in Point a, Clause 1, Article 14 of the Ordinance is defined as performing tasks while the battle is taking place or while the enemy is bombarding: ambulance, medical transport, ammunition loading, ensuring communications, protecting goods and combat assurance situations.
- Enemy-occupied areas, areas of war, and areas adjacent to enemy-occupied areas specified in Point b, Clause 1, Article 14 of the Ordinance are determined according to the provisions of Appendix III of this Decree.
- Directly perform combat training tasks, exercises or performing dangerous national defense and security tasks specified in Point g, Clause 1, Article 14 of the Ordinance is determined as follows:
+ Combat training and drill tasks are dangerous in the following cases: firing live bullets, using explosives; fire fighting; anti-terrorism and riots; free hostages; rescue, and response to natural disasters; in combat training and exercises of the forces: air force, navy, fishery control, coast guard, special forces, special reconnaissance, mobile police, and special forces.
+ Perform dangerous national defense and security tasks when: fighting fires; anti-terrorism and riots; free hostages; rescue, and response to natural disasters; perform the duties of fisheries surveillance and marine police; Search and gather martyrs' remains; clearance, treatment and destruction of bombs, mines and explosive materials; research, manufacture, produce, test, preserve and transport propellants, explosives, weapons and ammunition; Construction of underground defense and security works.
- Border areas, seas, and islands with particularly difficult conditions as prescribed in Point h, Clause 1, Article 14 of the Ordinance (hereinafter referred to as especially difficult areas) are areas with dangerous, harsh, difficult and prone natural conditions, including areas according to Appendix IV of this Decree.
Do not consider recognition for cases of illness in extremely difficult areas but have been taken for treatment at a provincial or higher hospital or illness in other places and have been treated but not cured but still remain to transfer work to areas with particularly difficult conditions.
- Directly performing the task of fighting crime specified in Point i, Clause 1, Article 14 of the Ordinance means directly performing tasks at the request of competent authorities to investigate, detect, prevent and arrest subjects committing crimes or preventing acts dangerous to society as prescribed in the Penal Code.
- Consider recognizing martyrs in the cases specified in Point k, Clause 1, Article 14 of the Ordinance, including the following elements:
+ Be fully aware of the danger and urgency of the incident.
+ Actively perform exceptionally courageous acts, accepting self-sacrifice.
+ Protect important interests of the State, the lives and legitimate interests of the People or to prevent and arrest people who commit particularly serious crimes.
+ Is a role model that has the meaning of honoring, educating, and spreading widely in society, was awarded a Medal and was organized by the state management agency for people with meritorious service to promote exemplary learning throughout the whole country.
- Other cases comply with the provisions of Points c, d, dd, e, l, m, Clause 1, Article 14 of the Ordinance.

Responsibility for preparing documents requesting recognition of martyrs
Article 15 of Decree 131/2021/ND-CP (Effective from February 15, 2022) stipulates responsibility for preparing documents requesting recognition of martyrs as follows:
- Agencies, organizations, and units directly managing martyrs are responsible for preparing dossiers requesting recognition of martyrs.
- Agencies, organizations, units, and individuals that discover or store information and documents related to deceased persons who have not been recognized as martyrs are responsible for providing them to the specified agencies, organizations, and units in Clause 1 of this Article as a basis for preparing a dossier requesting recognition of martyrs.
