Change in Hotel Room Scale: Where to Notify?
Hotel is one of the types of tourist accommodation establishments (Clause 1, Article 48 of the Tourism Law 2017).
And according to Clause 2(d) Article 53 of the Tourism Law 2017, organizations and individuals engaged in tourist accommodation services are obligated to notify in writing the provincial tourism authority where the accommodation establishment is located in the event of changes in the name, scale, address, or legal representative of the establishment.
Additionally, Point C Clause 2 Article 10 of Decree 45/2019/ND-CP stipulates a fine ranging from 1,000,000 VND to 3,000,000 VND for the act of:
Failing to notify about changes in the scale of the tourist accommodation establishment as stipulated.
Note: The fine levels specified in Article 10 of this Decree apply to individuals. For the same administrative violation, the fine level for organizations is twice the fine level for individuals.
Thus, when changing the scale of a hotel's number of rooms, you need to send a notification to the Department of Culture, Sports, and Tourism where the hotel operates. Failure to do so may result in administrative penalties for the hotel.
