Can cancer patients be exempt from compulsory community drug rehabilitation in Vietnam? How long is the compulsory drug rehabilitation period in Vietnam?
I am addicted to drugs, thanks to encouragement I have registered for drug rehabilitation in the community for a while. However, recently I discovered that I have cancer so I want to receive treatment. In this case, am I exempt from the rehabilitation period in the community? How long is the voluntary drug rehabilitation period? I hope the lawyers can advise. Thank you.
Can cancer patients be exempt from compulsory community drug rehabilitation in Vietnam?
Article 3 of Decree No. 116/2021/ND-CP stipulates the postponement or exemption from compliance with decisions on applying compulsory drug addiction treatment measures as follows:
3. Individuals who are required to comply with the decision but have not been placed in compulsory drug addiction treatment facilities shall be exempted from compliance with the decision in the following cases:
a) Suffering from serious illnesses confirmed by healthcare facilities at district level or higher;
b) During the period of postponement of compliance with the decision stipulated in Clause 1 of this Article, if the individual voluntarily undergoes drug addiction treatment and is confirmed by the competent authority to be drug-free;
c) Pregnant women with confirmation from healthcare facilities at district level or higher.
Therefore, if you are suffering from cancer and have a confirmation letter from healthcare facilities at district level or higher, you are exempted from complying with the decision on compulsory drug addiction treatment in Vietnam.

How long is the voluntary rehabilitation period in Vietnam?
According to Article 30 of the Law on Prevention and Control of Narcotic Substances 2021, the voluntary rehabilitation in families and communities is as follows:
1. Voluntary rehabilitation in families and communities is the process where drug addicts undergo voluntary rehabilitation in their families and communities with professional assistance from rehabilitation service providers, cooperation and support from their families and communities and management of the commune-level People’s Committee.
2. Voluntary rehabilitation in families and communities shall last from 06 to 12 months.

In addition, Article 31 of the Law on Prevention and Control of Narcotic Substances 2021 stipulates the voluntary rehabilitation in rehabilitation centers as follows:
1. Voluntary rehabilitation in rehabilitation centers shall last from 06 to 12 months.
2. Persons undergoing voluntary rehabilitation in rehabilitation centers are entitled to financial assistance for their rehabilitation after they have completed at least 03 stages provided for in Points a, b and c Clause 1 Article 29 of this Law.
3. Responsibilities of persons undergoing voluntary rehabilitation in rehabilitation centers:
a) Fully comply with regulations on voluntary rehabilitation and guidelines from specialized agencies;
b) Pay rehabilitation-related costs according to regulations.
Persons in difficult conditions undergoing voluntary rehabilitation in public rehabilitation centers may be exempt from paying all or part of the costs incurred.
4. Rehabilitation centers shall issue confirmations of completion of voluntary rehabilitation to persons having completed the rehabilitation.
5. The Government shall elaborate this Article.
Therefore, the voluntary drug addiction treatment period is from 6 months to 12 months in Vietnam.
