Are persons who undertake to take care of persons with serious disabilities entitled to allowance in Vietnam? What are persons with serious disabilities in Vietnam? 

My nephew was determined to be severely disabled, only 14 years old, and because there was no one else in the family, I took care of him. Can I ask, will I be entitled to any allowances? Thank you!

Are persons who undertake to take care of persons with serious disabilities entitled to allowance in Vietnam?

Pursuant to Clause 2, Article 44 of the Law on People with Disabilities 2010 stipulates as follows:

2. Entitled to monthly care-taking fund supports are:

a/ Families of persons with exceptionally serious disabilities that are directly nurturing and taking care of these persons;

b/ Persons who undertake to nurture and take care of persons with exceptionally serious disabilities;

c/ Persons with disabilities defined in Clause 1 of this Article, who are pregnant or nursing children under 36 months old.

Persons with disabilities defined at Clause 1 of this Article, who are children or elderly are entitled to allowances higher than others of the, same degree of disability.

The monthly social allowance level and monthly care-taking fund support level for each type of beneficiary under this Article shall be set by the Government.

Pursuant to Clause 1, Article 5 of Decree 20/2021/ND-CP regulating social protection beneficiaries eligible for monthly social benefits as follows:

1. Children who are under 16 years of age, receiving no nurture and:

a) abandoned without foster parent(s); or

b) without both parents; or

c) without a parent while the other is declared missing as per the law; or

d) without a parent while the other is receiving care, nurture in a social support facility or social housing; or

dd) without a parent while the other is serving prison sentence or complying with decision on penalties against administrative violations in reform school, mandatory education institution or mandatory rehabilitation center; or

e) having both parents declared missing as per the law; or

g) having both parents receiving care, nurture in social support facilities or social houses; or

h) having both parents serving prison sentences or complying with decisions on penalties against administrative violations in reform schools, mandatory education institutions or mandatory rehabilitation centers; or

i) having a parent declared missing as per the law while the other is receiving care, nurture in social support facility or social house; or

k) having a parent declared missing as per the law while the other is serving prison sentence or complying with decision on penalties against administrative violations in reform school, mandatory education institution or mandatory rehabilitation center; or

l) having a parent receiving care, nurture in social support facility while the other is serving prison sentence or complying with decision on penalties against administrative violations in reform school, mandatory education institutions or mandatory rehabilitation center.

Pursuant to Clause 1, Clause 3 and Clause 4, Article 20 of Decree 20/2021/ND-CP regulating regimes for households and individuals taking care of and nurturing subjects as follows:

1. The lowest monthly financing for care and nurture for each individual under Clause 1, Point d Clause 5 Article 5 hereof shall equal standard social support under Clause 2 Article 4 hereof multiplied by following coefficient:

a) 2.5 for cases of providing care and nurture for children under 4 years of age specified under Clause 1 Article 5 hereof;

b) 1.5 for cases of providing care and nurture for children from 4 years of age to under 16 years of age specified under Clause 1 Article 5 hereof and Point d Clause 5 Article 5 hereof.

 

3. Receive training for care and nurture operations.

4. Be prioritized for loan, vocational training for job creation, household economic development and other preferential treatment according to relevant law provisions.

According to this Article, if you adopt and take care of persons with exceptionally serious disabilities, you will be supported with monthly care costs. Your grandchild falls into the above category, so you will receive monthly care-taking fund supports when taking care of and raising your nephew. You will enjoy the following benefits: Financial support for monthly care and nurturing; Receive guidance and training in care and nurturing skills; Priority is given to loans, vocational training to create jobs, household economic development and other preferential regimes according to relevant legal regulations in Vietnam.

Pursuant to Point b, Clause 2, Article 3 of the Law on People with Disabilities 2010, the definition of persons with serious disabilities is as follows:

2. Persons with disabilities are classified by degree of disability as follows:

b/ Persons with serious disabilities are those whose disabilities render them unable to perform some of their personal daily-life activities;
