Are Elderly Persons from Poor Households Eligible for Funeral Allowance?
According to Clause 5, Article 5 of Decree 20/2021/ND-CP on the subjects of social protection benefiting from monthly social allowances, including:
The elderly falling into one of the following cases:
- Elderly persons belonging to poor households, without anyone obligated and entitled to support or having someone obligated and entitled to support but that person is receiving monthly social allowances;
- Elderly persons aged 75 to 80 belonging to poor households or near-poor households not specified in Point a of this Clause, living in areas of particularly difficult ethnic minority and mountainous regions;
And under the provisions of Clause 1, Article 1 of this Decree, the following subjects shall be supported with funeral costs upon their death:
- Subjects specified in Article 5 of this Decree who are receiving monthly social allowances;
- Children of single poor parents raising their children as specified in Clause 4, Article 5 of this Decree;
- Persons aged 80 and above who are receiving monthly social insurance benefits, other monthly allowances.
Thus, based on the information you provided, your uncle is an elderly person belonging to a poor household and is receiving monthly social allowances. Therefore, your uncle is eligible to receive funeral expenses.
About the level of benefit: At least 20 times the standard level (currently the standard level is 270,000 VND).
About the preparation of documents:
- A declaration requesting the support of funeral expenses from the agency, organization, household, or individual organizing the funeral for the subject according to Form No. 04 issued together with this Decree;
- A copy of the subject's death certificate;
- A copy of the decision or list suspending the social insurance or other allowances by the competent authority in the case specified in Point c, Clause 1 of this Article.
