Will Corruption Offenders Have Their Criminal Records Expunged According to the Court's Decision?
Clause 1 of Article 71 of the Criminal Code 2015 stipulates: Expungement of criminal records by court decision shall be applied to individuals convicted of offenses under Chapter XIII and Chapter XXVI of this Code when they have completed their main sentences, probation period, or the statute of limitations for sentence execution has expired, and they meet the conditions specified in clauses 2 and 3 of this Article.
Accordingly, individuals convicted of offenses against national security (Chapter XIII) and offenses of disrupting peace, crimes against humanity, and war crimes (Chapter XXVI) will have their criminal records expunged by court decision.
Corruption offenses are stipulated in Chapter XXIII; therefore, these offenses are still automatically expunged in accordance with Article 70 of this Code.
